09:03:02 course, our Bishop, our friend, Thomas Scott.

09:07:17 But before I present the commendation, I want to talk a
09:07:19 little bit about Women's History Month, Lily Simon.
09:07:27 But, you know, it's December 1 -- I'm sorry, I'm into next
09:07:40 year.
09:07:40 Anyway, March 1 through March 31. We are right in the
09:07:42 middle of it, and Women's History Month, the first
09:07:48 International Women's Day was March 8, 1911, and the first
09:07:53 conference was the School Board of Sonoma County,
09:08:00 California, in 1978, the year my daughter was born. Lily,
09:08:02 it took that long but here we are, and we are just moving
09:08:04 right along.
09:08:06 1980, president Jimmy Carter issued the presidential
09:08:11 proclamation moving this to Women's History Month.
09:08:16 Now I will present the commendation.
09:08:18 This 20th annual Woman's History Month celebration for
09:08:22 the City of Tampa.
09:08:23 The Tampa City Council proudly recognizes the City of
09:08:26 Tampa's 20th annual Women's History Month celebration on
09:08:32 March 23, 2016, and acknowledges the outstanding efforts of
09:08:36 the 2016 Women's History Month celebration planning
09:08:41 committee, right here, declared nationwide, Women's History
09:08:44 Month is a tribute to the generation of women who committed
09:08:47 and contributed and has proven invaluable to our nation's
09:08:51 history and contemporary society.
09:08:53 The Tampa City Council, City of Tampa Women's History Month,
09:09:00 celebration and planning committee for highlighting our own
09:09:04 community leaders and congratulations this year's Josephine
09:09:07 Howard Stafford memorial to Jeanette la Rusa Fenton.

09:09:17 And who 20 years ago founded Tampa women's history
09:09:27 celebration.
09:09:28 Thank you for your work in the city as we honor the
09:09:31 extraordinary contributions and remarkable women of Tampa

09:12:26 I'm here today working with OAI, a visual branding company
09:12:30 regarding item number 8, which is a resolution involving
09:12:33 street pole banners, which in the city is really quite a big
09:12:40 business.
09:12:41 We are not here to challenge the city attorney's opinion
09:12:43 that you will hear from in terms of control that you have
09:12:46 over TECO, and we are not really here challenging that
09:12:51 opinion regarding those poles being operated in the public
09:12:54 right-of-way and carrying taxpayer messaging but we are
09:12:57 asking your consideration to revise the amendment or
09:12:59 resolution before you as a matter of policy, which that
09:13:04 resolution would extend, in our opinion, would extend the
09:13:07 monopoly. It's a monopoly of a single source.
09:13:08 So we are asking for a resolution to reflect that anyone,
09:13:17 anybody who provides the best prices, provides the best
09:13:20 service, best creativity, to carry those civic or community
09:13:23 messages, to do so on a fair market basis, really just as
09:13:30 simple as that. We consider it a good government
09:13:32 consideration.
09:13:32 On the web page of what they call the public-private
09:13:36 partnership, let's make it a real public partnership in that
09:13:39 regard.
09:13:40 So I do have a handout that I would like you to consider
09:13:43 when you come to the item as a modification or revision to
09:13:46 the amendment.
09:13:47 And we ask you not to support the resolution as it currently
09:13:50 exists because, in our opinion, it perpetuates a monopoly.

09:14:08 Dr. Martin Luther King Jr. said that injustice anywhere is
09:14:14 injustice anywhere.
09:14:16 My name is Michael Cooper here to speak on behalf of OAI, a
09:14:19 public banner company, and the revision to resolutions
09:14:23 related to banner programs.
09:14:26 Garcia, the owner of OAI, over 25 years ago at the time he
09:14:31 founded the company, and as his company grew he supported
09:14:34 our countywide youth program.
09:14:36 Today he continues to support those youth programs and he
09:14:40 has donated over $200,000 in money, goods and services over
09:14:44 the years.
09:14:45 More over, he has given even more to other local and state
09:14:48 wide charities focused on underserved children, including
09:14:51 the children and many others.
09:14:57 He and his company are an important asset to our Tampa Bay
09:15:01 community.
09:15:02 As diversify and inclusion I have dedicated my life to
09:15:07 justice and quality for all.
09:15:13 Printing pole banners, and cronyism.
09:15:16 It is unfair competition, and a monopoly and not the way to
09:15:20 conduct business by government agencies, or those involving
09:15:24 the general public.
09:15:25 The practices are antiquated and I ask that you review the
09:15:29 current policies and guidelines and level the playing field
09:15:31 for providing pole signs, and doing business in any area
09:15:36 that does not ensure equality and fair opportunity for all.

09:15:55 My name is Tom feaster.
09:15:58 And I live at 401 Harbor Island place drive in Tampa,
09:16:02 Florida.
09:16:04 I'm also commenting regarding the pole banner resolution
09:16:07 which is on the agenda as number 9.
09:16:10 No question about the resolution.
09:16:12 It's a good idea.
09:16:13 Just needs some serious tweaking the way it's written.
09:16:18 It should be written in such a way that selling and printing
09:16:21 the banners on public rights-of-way in the city is open to a
09:16:25 bidding process involving multiple vendors.
09:16:29 Having had a little experience in this process, I chaired
09:16:34 the decorations committee for both of the Super Bowls, the
09:16:38 last two Super Bowls that we had in Tampa.
09:16:40 And one of the things that the National Football League
09:16:44 required was a competitive process for the selection of
09:16:49 printers for all decorations for the event including pole
09:16:52 banners.
09:16:53 It worked well.
09:16:55 And it also allowed minority companies to participate in the
09:16:59 process.
09:17:02 It was no surprise how our committee was able to get the
09:17:05 best products at the best price.

09:17:12 >> I'm Ellen Snelling, the chair of Tampa Alcohol Coalition.
09:17:19 I want to make a comment on one of the items.
09:17:22 I don't know the number.
09:17:23 But it's about educating bars and people that patron it is
09:17:29 bars about the ordinance that would allow them to leave
09:17:33 their car overnight if they had too much to drink without
09:17:36 worrying about being towed.
09:17:39 I think this is great.
09:17:40 I would love to work with the city on anything we can do to
09:17:43 prevent intoxicated driving.
09:17:45 It's a great day to be talking about this, St. Patrick's
09:17:47 Day, because I know a lot of people partake of green beer
09:17:51 and other alcoholic beverages tonight which is great.
09:17:53 We want people to have fun but we do not want anyone to get
09:17:56 in their car when they are under the influence and possibly
09:17:59 cause a catastrophic crash.
09:18:00 I would leak to just mention the crash that occurred over
09:18:03 the weekend, the wrong way crash, being investigated for
09:18:05 alcohol possibly being involved and the person may have gone
09:18:10 to a bar.
09:18:10 So if there's any way we can prevent that by educating
09:18:14 people, that they can leave their car overnight if they had
09:18:16 too much to drink, instead of posting the ordinance itself,
09:18:21 maybe a catchy sign that people would pay attention to, that
09:18:24 can change with the holiday.
09:18:25 We really want people to learn about this and know they can
09:18:28 do it, and of course the tow companies and the bars
09:18:31 themselves.

09:20:15 I don't know why you don't use eminent domain.

09:20:24 Why do you all do injustice to our people, people like me?
09:20:27 There's no justice for people like us in the United States
09:20:29 of America, and it's true.
09:20:32 When we try to stand up for our rights, nobody wants to hear

09:22:07 I noticed last night the strip club might be reopening,
09:22:11 which is really good because a lot of homeless people were
09:22:16 setting up around the neighborhood, and somehow that kept
09:22:18 them away.
09:22:20 It's really too bad those eight people were shot and two
09:22:26 died.
09:22:27 But, in any case, I'm here -- I don't have any handouts, and
09:22:33 I am going to be a little less focused.
09:22:36 But what happens is I had adult whooping cough which I
09:22:42 should call to your attention, form of pneumonia, and most
09:22:45 people won't get it, but older people will.
09:22:49 And the reason for that is because after you have lived for
09:22:52 so long, and there is vaccination and immunization.
09:23:04 And it has been eliminated from Rick Scott's coverage.
09:23:07 So the thing is, I don't know, you go to a doctor and say
09:23:14 adult whooping cough, and probably not know what you are
09:23:18 talking about, but it will cost you.
09:23:20 And it shouldn't.
09:23:21 But anyway, be that as it may.
09:23:25 I was going to speak just quickly about the initiative
09:23:30 because I think a very important ball has been dropped and
09:23:33 that's age.
09:23:34 You want to do something.
09:23:35 This woman came here and talked about 25 years old, and
09:23:42 there's a saying in religious society, speak truth the
09:23:45 power.
09:23:46 And that's what she was doing.
09:23:48 It was an very pro-part audience.

09:23:54 You should pick up that ball on behalf of the kids, in their
09:23:58 late teens and early 20s.

09:24:03 Oh, yes, I did make a very serious mistake.
09:24:07 I thought 28 grams was a teaspoonful.
09:24:11 No, 28 grams is an ounce which is two tablespoons full and
09:24:17 each is three teaspoonfuls so 6-teaspoonsfuls, I guess a
09:24:25 year ago was a major part of a lid.
09:24:32 I don't even know if those are the terms anymore.

09:24:51 The Environmental Protection Commission over at the county
09:24:54 is a disaster, a total disaster, and the chairman of the
09:24:58 committee is politically correct as the day is long, but it
09:25:02 is a disaster, it is counterproductive.
09:25:04 It's like environmental engineer 30 years ago.

09:25:32 Thank you for your comments this morning.
09:25:34 My name is Aaron Canola with the Central Florida Labor
09:25:39 Council.
09:25:40 While I am no longer a resident of the beautiful City of
09:25:42 Tampa, I do vote in Florida and elections.
09:25:46 This is on specific partnerships and it really makes me
09:25:51 nervous the agreements this will have on voters like myself,
09:25:54 Tampa residents, and citizens all across the country.
09:25:58 One of the most concerning aspects of this agreements is
09:26:00 what they call ISDS, investor state dispute settlement
09:26:05 system.
09:26:05 And my worry is that it's going to have a chance to override
09:26:09 decisions made by elected officials that folks like me and
09:26:13 you have put into office at all different levels in this
09:26:16 country.
09:26:16 One of the key issues that we can cite is one that involves
09:26:21 the keystone XL pipeline.
09:26:24 As now that was an argument for almost eight years through
09:26:27 different levels of the national government, and through our
09:26:30 system of federal government, it was declined by the Obama
09:26:32 Administration.
09:26:33 Now, our country is getting sued by Transamerica for not
09:26:37 allowing that pipeline to come through.
09:26:39 And one example to notice about what our country does and
09:26:44 how we can be held hostage by these International companies.
09:26:49 It's just one of the many issues outlined in the resolution.
09:26:52 I just want to thank you all for putting this up.
09:26:56 Because the city needs to understand, hopefully people will
09:26:58 understand what this agreement is all about.

09:27:12 In recent days, recent days of this week, certain residents
09:27:19 of West Tampa brought to my attention a notice that you
09:27:25 received in the mail of rezoning the area of West Tampa,
09:27:32 north Morgan Avenue, east of the river, west of Rome, R
09:27:38 Avenue, and south to the interstate.
09:27:42 The businesses in the area ask that this City Council do not
09:27:52 put that on the agenda --
09:27:56 >>FRANK REDDICK: Mr. Bolden, let me stop you here.
09:28:00 That item is set for a public hearing.
09:28:02 And you have to wait until it comes up on the agenda for
09:28:08 public input.
09:28:15 Because there may be a lot of speakers to this.

09:28:45 citizens that came to me, he would want to ask that this
09:28:50 council do opposing that on the agenda for the 14th and
09:28:56 28th of April.

09:29:02 public hearing, the public can come and speak before the he
09:29:06 shall you when it's scheduled on the agenda.
09:29:08 We are not inclined to not put it on the agenda.

09:29:12 So when we set the public hearing, put everybody on bus 12,
09:29:18 bring them down here, and they have a public hearing, they
09:29:20 have an opportunity to speak for three minutes, and we will
09:29:28 have a fair discussion, and the council will make a decision

09:30:01 My name is David Bernstein.
09:30:03 I live in South Tampa.
09:30:04 And I am a member of the City of Tampa for years, and I am
09:30:10 here to speak on item number 10, the TPP.
09:30:16 As a senior citizen, I am very much worried about what can
09:30:20 happen to the medicine in this deal.
09:30:27 Doctors without borders, and Americans degree TPP contains
09:30:35 extreme patent protections for name brand pharmaceuticals
09:30:39 that threaten to restrict access to life saving medicine and
09:30:44 in all TPP countries including the U.S.
09:30:51 Will the TPP make medicines more expensive?
09:30:55 Will the drug pricing divisions give foreign pharmaceutical
09:31:00 companies more leverage to force Medicare to cover their
09:31:04 products and pay higher prices for them?
09:31:07 Yes, we think they will.
09:31:09 There is a lack of transparency here and a bad deal for all
09:31:15 Americans.

09:33:12 brown, president of the Tampa alum chapter of Delta Sigma
09:33:17 Theta incorporated in which our national president Paula

09:33:23 Today we celebrate our 10th annual Delta day here at
09:33:27 City Hall and with R we graciously appreciate the
09:33:29 opportunity to participate and be recognized today.
09:33:32 We are proud to continue the legacy of our founders by
09:33:35 providing dedicated and committed service to the Tampa Bay
09:33:39 community.
09:33:40 Since our organization's inception, social action has been
09:33:43 at the forefront of our work to promote active involvement
09:33:47 in local, state and national advocacy on issues in pass
09:33:54 impacting the African-American community. This year we have
09:33:56 several priorities including sponsoring voter registration
09:33:59 and voter education programs, combating voter suppression,
09:34:03 access to affordable health care, and gender equality
09:34:07 issues, just to name a few.
09:34:09 >> Under the auspices of our sorority's 5 point program at
09:34:14 thrust we aim to have promote academic excellence, provide
09:34:17 scholarships and provide support to the underserved in the
09:34:20 areas of economic development, educational development,
09:34:24 International awareness and involvement, physical and mental
09:34:28 health and political awareness and involvement we develop
09:34:31 award winning programs designed to encourage intellectual,
09:34:36 physical and spiritual development of our community.
09:34:38 Over the past 20 years, the Tampa chapters of Delta Sigma
09:34:42 Theta have provided nearly a half million dollars to
09:34:45 deserving students in Hillsborough County.
09:34:48 In addition to scholarships, we proudly offer programs that
09:34:51 promote voter registration, financial fortitude and cultural
09:34:56 interventionalists.
09:34:58 We have done our part in the economic opportunity start
09:35:01 area, hosting our sore reported's 2014 regional conference
09:35:06 as well as competing for the 2019 national convention.

09:35:14 members we have here in the Tampa Bay area and from more
09:35:19 than the 50,000 women we have active in our sorority.
09:35:23 But we are the embodiment of the seam we bring which is

09:35:33 national president, Dr. Walker, it is our desire to continue

09:37:39 seeing if it's required, or in your opinion needs reworking.
09:37:43 Obviously this is going to be something that is naturally
09:37:49 going to have to change since this is a Hillsborough County
09:37:51 ordinance.
09:37:52 The attorney that's been working on this with Hillsborough
09:37:54 County has been working with Mr. Shelby as well.
09:37:57 So I think we have a good handle on some of the changes that
09:38:01 needs to be made. But we are still working with the county
09:38:05 on how the implementation is going to take place.
09:38:08 So I would like to have all of those ducks in a row, if you
09:38:12 will, before we pass the resolution, because I always like
09:38:15 to know how this is going to be implemented before we take
09:38:18 any action.

09:38:26 >>HARRY COHEN: If we were to do nothing, would we just come
09:38:29 under this ordinance?

09:38:36 2, its own ethics ordinance, with its own definition of
09:38:40 lobbyists and its own processes.
09:38:43 >>HARRY COHEN: So if we repealed that we would come under
09:38:46 this ordinance?
09:38:47 >>MARTIN SHELBY: If you take a look at what this ordinance
09:38:50 says it actually puts the county attorney in charge of the
09:38:56 enforcement of this, and where the City of Tampa has the
09:39:00 ethics commission, it would be problematic.
09:39:04 >>HARRY COHEN: So it would be the right thing to do to have
09:39:06 our own ordinance?
09:39:08 >>LISA MONTELIONE: But I am also asking Hillsborough County
09:39:10 to play a role in that lobbyists wouldn't have to register
09:39:17 twice.
09:39:17 Just the same way we have merged system for employee
09:39:21 applications and using domestic partnership registry and
09:39:27 things like that, they would have the responsibility of
09:39:33 taking in the lobbyists applications, listing them on the
09:39:37 website, which is spoken about here in the county's
09:39:40 ordinance, but then that would be a reciprocal registration.
09:39:48 So if you were registered as a lobbyist in Hillsborough
09:39:50 County, City of Tampa would accept that vetting of that
09:39:55 lobbyist, and the listing in Hillsborough County as
09:39:58 pertaining to the City of Tampa.
09:40:00 But that's where would you separate.
09:40:04 >>HARRY COHEN: So you are going to bring it back?
09:40:08 >>LISA MONTELIONE: Mr. Shelby, has the county indicated
09:40:11 when they would get back to us on their implementation
09:40:14 policy?

09:40:17 the assistant county attorney responsible today, as a matter
09:40:21 of fact.
09:40:21 So I would ask, in order to have the legal department come

09:41:33 Because really, right now, the way that they do it at the
09:41:36 state level, you know, if you lobby the executive branch of
09:41:39 the house or the Senate separately, there is -- and they
09:41:43 have a mechanism in which they show them as registered
09:41:46 lobbyists, which is what this is trying to do.
09:41:49 But is it in terms of how we do it now?
09:41:54 Obviously we have them sign in afterward.
09:41:57 They have to be registered as a lobbyist.
09:41:59 For example, we may meet with someone that may have a
09:42:04 position with a lobbying firm but may not be registered as a
09:42:07 lobbyist.
09:42:08 I think we need to catch that in addition to the lobbyist.
09:42:12 I would just ask Q that we look into that when it comes back
09:42:15 next time.
09:42:15 >>LISA MONTELIONE: So there are definitions in the
09:42:17 Hillsborough County ordinance, and we can either accept
09:42:20 those definitions as is, or -- that's why I wanted everybody
09:42:25 to have the chance to read through and be able to make
09:42:28 suggestions.
09:42:29 But the registration would be -- and let me use a different
09:42:34 example, the registration would be much like a contractor
09:42:37 registers for a small minority local business.
09:42:40 If you register in Hillsborough County and proves they are a
09:42:43 local business, we accept that, and in reciprocal fashion.
09:42:48 So it would just be simply the registration that would take
09:42:53 place.
09:42:56 >>MIKE SUAREZ: And that's all this ordinance would entail
09:42:58 is the registration itself.
09:42:59 >>LISA MONTELIONE: Right.
09:43:02 >>MARTIN SHELBY: That was not my understanding.
09:43:05 Correct me if I am wrong but my understanding was for the
09:43:07 sake of consistency and complicity was to align the city's
09:43:13 definition of lobbyist and lobbying with the definitions
09:43:17 that were just recently adopted by Hillsborough County so
09:43:19 there would be no confusion, and it would also address some
09:43:22 issues that everybody coming up that the county has
09:43:25 addressed in amending its language that the city may very
09:43:28 well face with existing language if you follow what I am
09:43:32 saying.
09:43:33 >>LISA MONTELIONE: Well, we can have a more in-depth
09:43:35 discussion when it comes back.
09:43:36 >>MIKE SUAREZ: That's what I wanted to understand.
09:43:38 >>LISA MONTELIONE: But we can accomplish that with aligning
09:43:41 with Hillsborough County for registration and then making
09:43:43 those changes that we see specific in the implementation
09:43:46 part of it, because we would be having our own enforcement.
09:43:51 So I think throws a way to work through it.

09:43:56 charging $50 annually to be a lobbyist.
09:43:59 And they are going to be registered with Hillsborough County
09:44:03 and obviously we are not going to see any of that money, it
09:44:06 seems like, unless we pass our own ordinance with the same
09:44:09 language.
09:44:09 >>LISA MONTELIONE: Well, a lobbyist not registered with the
09:44:13 county registers with the city.

09:44:58 Jean Duncan, transportation and stormwater services.
09:45:01 I apologize, I didn't get a chance to put this information
09:45:04 in the PowerPoint but I would like to give you a little
09:45:07 handout.
09:45:16 the motion, as you are aware, was to bring some information
09:45:28 back regarding the City of Tampa's mass transit projects in
09:45:35 the go Hillsborough initiative.
09:45:44 >>YVONNE CAPIN: Wait.
09:45:44 I made this motion.
09:45:46 This is a separate motion for City Council but there was one
09:45:50 for the CRA.
09:45:51 And it pertained to be the part of the proposed rail
09:45:59 service.
09:45:59 Not mass transit.
09:46:01 Not the bus.
09:46:02 Not paving the roads.
09:46:03 It's the rail service.
09:46:05 >>JEAN DUNCAN: Yes.
09:46:08 >>YVONNE CAPIN: And those four objectives.

09:46:11 >>JEAN DUNCAN: Yes, ma'am, that's what I have come to
09:46:13 share.
09:46:14 Using terms interchangeably but I will use the term rail
09:46:18 service.
09:46:19 So the motion similar to the CRA motion was about the cost,
09:46:25 technology alignment that was in the Hillsborough
09:46:28 initiative.
09:46:32 Just a very quick recap of the "go Hillsborough" initiative.
09:46:40 A quick recap on the "go Hillsborough" initiative.
09:46:57 This initiative started almost three years ago now.
09:47:00 And started with the formation of the policy leadership
09:47:04 group, which was three mayors of our county, the Board of
09:47:08 County Commissioners, and the Hart share.
09:47:11 Those agencies worked together for a solid year putting
09:47:18 together financial and other information together, started a
09:47:24 formal public engagement process, as part of that
09:47:27 initiative, and produced a report in November of last year.
09:47:34 And the outcome of that initiative is basically a combined
09:47:39 community plan for our throw cities, our county, and our
09:47:43 Hart system, as well as a half percent sales tax strategy.
09:47:53 So just a little bit more on the public engagement.
09:47:57 There was extensive public engagement on this initiative.
09:48:00 We had initially 36 workshops throughout the entire city and
09:48:04 county.
09:48:05 The second phase had another 54 workshops.
09:48:12 22 of those being in the City of Tampa.
09:48:15 Information was on the GoHillsborough website and is there
09:48:20 today for any information that any of our viewing audience
09:48:22 might want to take a look at.
09:48:24 So that's the question that was asked.
09:48:28 There were two rail projects that were included on the City
09:48:32 of Tampa's project list.
09:48:34 The first rail project came out of the MPO and long range
09:48:42 transportation plan and other planning study called the
09:48:45 transit assets and opportunity study.
09:48:47 We utilized that planning information and those cost
09:48:50 estimates for our project list.
09:48:54 The cost estimate of the rail project that would go from
09:48:57 downtown to Tampa International Airport was about $480
09:49:02 million.
09:49:04 The funding sources anticipated in our GoHillsborough list
09:49:08 were the half percent sales tax.
09:49:12 >>YVONNE CAPIN: I have a question.
09:49:13 That half percent sales tax equates to what dollar amount?
09:49:17 >>JEAN DUNCAN: Let me get that for you.
09:49:20 The half cent would yield about $593 million over 30 years,
09:49:43 and the first ten years would yield a total of 197 -- almost
09:49:49 198 million for the City of Tampa.
09:49:58 So we utilized those planning cost estimates for our project
09:50:03 list, and we are anticipating issuing debt, utilizing bonds,
09:50:10 utilizing FUT grants, STA grants, state New Start dollars,
09:50:16 and potentially public-private partnership opportunity to
09:50:20 finance that rail project.
09:50:23 The alignment and the technology have not been pinned down.
09:50:29 I will share a little bit about that.
09:50:33 Basically, there's a process we need to go through to
09:50:37 identify the specific alignment and technology.
09:50:42 Those details have not been decided through the MPO work
09:50:45 that's been done thus fore.
09:50:49 There is the national environmental policy act, which is a
09:50:53 federal process we have to go through to develop those
09:50:57 particular decisions.
09:50:58 I can tell you where we are with that so far.
09:51:14 I apologize.
09:51:17 The rail project that would go from downtown to TIA.
09:51:27 Recently announced over a million dollar grant they are
09:51:29 making available.
09:51:31 They are currently working with Hart to develop a scope
09:51:36 project.
09:51:36 It's going to have a regional view.
09:51:38 They are working with the TMA, transit management area
09:51:46 group, a lot of acronyms to keep straight in the
09:51:50 transportation world.
09:51:51 This process follows the NEPA process.
09:51:56 They are estimating about an 18 to 24-month time frame to
09:52:00 get kicked off and expecting to get that started in the fall
09:52:04 of this year.
09:52:04 And that planning level study is going to cover a
09:52:08 three-county area.
09:52:09 They will be looking at the tracks that were recently
09:52:15 offered up for sale by CSX.
09:52:18 However, we have determined the use of those as we go
09:52:20 through the process.
09:52:21 Once we get through that process, the next stage would be
09:52:25 the national study.
09:52:30 Very quickly, the other rail project that we had in our
09:52:33 GoHillsborough list, we had our streetcar project.
09:52:37 The basis of the information on our list came from Hart
09:52:41 recent planning study that they did to look at modernizing
09:52:47 and expanding the streetcar system.
09:52:49 That study identified a cost estimate of 146 million.
09:52:53 Again, we would utilize the city's portion of the half
09:52:56 percent sales tax.
09:52:59 State grants.
09:53:00 Federal transit authority grants.
09:53:02 And the same as the other rail study, the technology and
09:53:06 alignment have not been specifically identified for that
09:53:09 street car project either.
09:53:11 It is and a half matching state, however.
09:53:15 We recently put out an RFU to secure consultants with the
09:53:20 goal of extending and modernizing the existing streetcar
09:53:23 system to make it a viable transportation option.
09:53:27 Currently, the scope calls for looking to possibly the
09:53:33 Marion street center or Tampa Heights.
09:53:39 >>YVONNE CAPIN: We are looking at not only the rail from
09:53:44 downtown to the airport but also the streetcar included in
09:53:47 this dollar amount?
09:53:50 >>JEAN DUNCAN: The rail of downtown CRA is the 480 million
09:53:57 and the streetcar is the 146 million.
09:54:01 >>YVONNE CAPIN: Okay.
09:54:01 Which one is first?
09:54:04 In priorities for the administration?
09:54:06 >>JEAN DUNCAN: The streetcar would occur first because
09:54:10 there's more existing opportunity right now for that to go
09:54:12 forward, and we would be working with all-a board Florida,
09:54:17 the FDOT, to look at making a connection on the northern end
09:54:22 that would integrate with strategic connections to the west
09:54:25 over to Tampa International Airport.
09:54:32 >>YVONNE CAPIN: The first 197 million, how much of that
09:54:36 would be spent on the streetcars?
09:54:39 Do you know?

09:55:26 public-private opportunities that come along as well.

09:55:41 This is more of a priority than getting people from the
09:55:43 airport to downtown.
09:55:44 >>JEAN DUNCAN: We can say it's all a priority.
09:55:48 But in terms of the cost under the GoHillsborough plan,
09:55:58 there's less planning required and there's less dollars
09:56:01 required.
09:56:02 And it could be the first link to extending further to the
09:56:05 west.

09:56:25 So much can happen in 2001 months -- two years.

09:56:40 certain maybe personal priorities that the citizens might
09:56:45 have, priorities which were expressed through the
09:56:47 GoHillsborough process.
09:56:50 But there are so many groups weighing in on priorities.
09:56:53 So we have got the MPO has a priority list.
09:56:57 We have, you know, a short-term priority, long-term
09:57:01 priority, we have projects that funded.
09:57:03 We have projects that are unfunded on those priority lists.
09:57:07 And then the transportation management area group which is
09:57:11 Pinellas, Pasco County and Hillsborough County, we have a
09:57:14 set of priorities there regionally, and each county, each
09:57:19 entity has their priorities.
09:57:21 So to say which one would come first when we talk about
09:57:26 whether it would be the upgrades to the trolley and make it
09:57:30 a modern trolley system tore CSX rail or light rail to the
09:57:35 airport, depending on which list you are looking at and
09:57:39 whose priority list you are log at, they fall in different
09:57:43 places, because for the regional transportation management
09:57:47 area group and the chair coordinating committee, and those
09:57:54 groups, see more of the CSX as a priority because they would
09:57:59 be served by that.
09:58:01 They wouldn't necessarily be as served by our local
09:58:05 expansion and modernization of our trolley system here.
09:58:09 So it's hard to say which is "the" priority because there
09:58:14 are so many groups that have different priorities for
09:58:16 different reasons.
09:58:18 I think I know what you are getting at.
09:58:20 There's no doubt that sales tax is not going to provide the
09:58:22 amount of money we need.
09:58:26 >>YVONNE CAPIN: I understand, but my question was the
09:58:28 priority of this administration, which is the one that
09:58:30 speaks for the city in saying we have it, we will spend it
09:58:36 on rail.
09:58:37 And I wanted the details on how that is going to be done.
09:58:42 That is the priority of this administration:
09:58:49 From what I understand -- and it is the mayor's statement
09:58:51 that we will have the money for rail, but the details to
09:58:57 that rail is what I wanted -- I wanted to hear at City
09:59:02 Council.
09:59:03 I know there's a lot out there.
09:59:04 Throws a lot of out, a lot of priorities.
09:59:06 But this administration talked about using the city's money
09:59:11 for rail.
09:59:12 So that's what I was getting at.
09:59:15 I want to be hear the details on it as much as we have.

09:59:24 >>YVONNE CAPIN: Those questions were the ones that I asked
09:59:26 at the CRA meeting and my fellow council member made the
09:59:30 motion to -- which was the funding, the technology, which we
09:59:35 don't have, but, you know, I know that we must follow the
09:59:46 process but we need an idea of what the technology is going
09:59:50 to be.
09:59:50 >>JEAN DUNCAN: We have planning work that's been done for
09:59:54 both streetcar and rail.
09:59:55 We are basing our cost estimates on that framework.
09:59:59 And both of those initiatives take more steps to follow to

10:00:40 We will be kicking that off probably this summer with our
10:00:43 scoping negotiated and our man hours and all of that, and
10:00:47 D.O.T. offered a grant of a million dollars to get that
10:00:51 started.

10:01:24 often have when we get into these discussions is that the
10:01:28 study is sitting there and they appear like they are going
10:01:31 to take years and everyone is so anxious to move forward.
10:01:34 It's very frustrating to see another perceived roadblock.
10:01:39 My understanding is if we don't Don the study, he would
10:01:43 basically for fit our ability to get any federal funds.
10:01:47 And one of the things with TMA is everyone gets excited to
10:01:55 talk about the different technologies and different options,
10:01:57 and D.O.T. gets very, very nervous about that because they
10:02:01 are afraid that if we start coming to preconclusions about
10:02:05 what we need prior to doing the study, that it will
10:02:09 undermine our ability to get the federal funds and it's very
10:02:13 frustrating.

10:03:37 calling the premium transit which of course would include a
10:03:40 rail possibility.
10:03:42 So that study is the city streetcar study.
10:03:45 We will have a robust public engagement for both of those
10:03:48 projects.
10:03:48 We want to make sure we hear from the public, and we provide
10:03:51 information on what we are looking at.
10:03:53 So both will be getting connected off this year.
10:03:57 There will be more opportunities for public engagement to
10:04:00 share information and get input from both sides.

10:04:10 It's really unfair of us to have you here because, you know,
10:04:13 when you went into the bowl of alphabet soup that is small
10:04:19 start, new start, all the other stuff that deals with just
10:04:22 with transit, and it's something that you don't really deal
10:04:25 with because, you know, you are busy actually making sure
10:04:28 that our roads work and our streets are -- potholes are
10:04:32 filled, but it's a little bit more difficult for her because
10:04:36 she is not the expert on this.
10:04:38 And I'm not saying anything rude to you by saying that.
10:04:42 >>JEAN DUNCAN: No, you are not, and we work closely with
10:04:46 our Hart colleagues and doing a lot of our own homework to
10:04:49 get a little smarter on some of the technology and
10:04:52 information we need to have.
10:04:53 >>MIKE SUAREZ: And one of the things I want to make a
10:04:57 comment about, and Ms. Capin made comments about what
10:05:00 priority is, priority is get money.
10:05:06 Second priority, because we have streetcar there are two
10:05:09 things that need to happen.
10:05:10 The current trolley that we have will not exist as it is.
10:05:13 It will be a modern streetcar, because federal rules
10:05:16 concerning the expansion of the extension of it.
10:05:18 The second thing is that there may be some opportunity for
10:05:21 us to use some city dollars, but that's not mentioned in
10:05:24 this here because we are making sure that we have our FTA
10:05:29 dollars, our FDOT dollars, any federal dollars that are
10:05:33 available first before we start talking about city dollars;
10:05:37 I think.
10:05:37 And then the third thing is that with Hart, Hart leads it
10:05:41 only because Hart is the designated recipient of most lead
10:05:46 dollars.
10:05:46 So it's truly a partnership, because we may say we have a
10:05:49 project that we want to do.
10:05:50 Hart is the agency that currently runs our street car.
10:05:55 Because we own the tracks, we own the streetcar.
10:05:58 We do have, as you know, Ms. Capin, because you served on it
10:06:02 with me, our streetcar board, that may or may not still be
10:06:05 around after, you know, a year or two.
10:06:08 And because of that, we really do need to set our
10:06:11 priorities.
10:06:12 If this study comes back where we say it's going to cost 146
10:06:17 million or it's going to cost us, you know, less than that,
10:06:19 or north of that, either way we are going to have a lot of
10:06:23 work to do here from our perch straight from what Hart does,
10:06:28 separate from what some of the other agencies like MPO and
10:06:32 the transportation management agency -- excuse me, group
10:06:36 does.
10:06:36 So I appreciate you coming here because it really is tougher
10:06:38 for you to talk about transit because this is not your
10:06:41 forte, and it's not your expertise, and I appreciate you
10:06:44 taking the time to be here with us.

10:06:51 decide who they wanted to present, then it was suggested you
10:06:59 because you are just very eloquent and do so well.
10:07:07 At the CRA, I was absent, and Councilman Maniscalco made the
10:07:14 motion, in the evening session of City Council, but I did
10:07:18 ask whoever the administration felt could bring us the
10:07:21 information.
10:07:23 So if the administration was --

10:07:30 undertaking.
10:07:31 >>LISA MONTELIONE: I am going to do my public service
10:07:36 announcement a little early.
10:07:39 For those who are constituents, and I know there's a very
10:07:44 vocal group that's on Facebook, and there are folks who are
10:07:47 now getting involved in this whole transportation
10:07:51 discussion, which was prompted by the -- so many people are
10:07:59 now involved in paying attention and expressing their
10:08:01 opinions than ever before.
10:08:03 So I am really grateful for their organization, sunshine
10:08:07 citizens and all of those, who have been involved.
10:08:10 But, you know, coming to the MPO meetings or which I asked
10:08:15 for and the MPO has complied with, they take public comment
10:08:20 electronically at the MPO.
10:08:22 So all the agenda is online.
10:08:25 They can comment electronically.
10:08:26 You don't have to come downtown for a 9 a.m. meeting to do
10:08:29 so.
10:08:30 And that process has been working out great.
10:08:32 But all of the ongoing studies for all these different
10:08:36 projects, whether it's the streetcar, whether it's light
10:08:42 rail, whether it's the commuter rail, whether it's the
10:08:44 premium transit study, all of the information is on the
10:08:47 MPO's website.
10:08:48 So that's a good place for people who have questions to get
10:08:53 answers, is to go to the website.
10:08:55 I just want to make sure that people understand -- and Ms.
10:08:59 Duncan said it, and I think you are an expert.
10:09:02 I am going to -- you have been around all the time, you come
10:09:06 to all the MPO meetings, or the TMA meetings, and I don't
10:09:09 know how you actually get sleep.
10:09:11 But, anyway, the premium transit study is the one that I
10:09:17 invited secretary Simon here to come to a CRA meeting, and
10:09:22 we were very vigorously, I should say, discussing the TBX
10:09:27 project.
10:09:27 That's where secretary Simon announced that he would be --
10:09:31 it was FDOT, would be paying for that study that is now
10:09:36 being done and in process of scoping with Hart.
10:09:40 So folks watching us can get some details, too.
10:09:47 But transit takes a long time.

10:10:08 >> Dennis Rogero, mayor's chief of staff.
10:10:16 I have some information for you today, not a lot of detailed
10:10:20 information for you.
10:10:21 And I won't have detailed information for you for some time,
10:10:25 and I will explain why.
10:10:27 If you allow me to recap a couple of things, of course, we
10:10:30 have gone through the initial resolutions up in New York
10:10:34 with the NFL.
10:10:36 They won't make a decision for another two months in terms
10:10:39 of which cities are going to get the Super Bowl.
10:10:43 It's my understanding the dates have also been expanded to
10:10:45 include a third Super Bowl, talking 2019, 2020 and 2021.
10:10:52 Having said that, when we are informed we have gotten one,
10:10:57 we will enter into discussions with them.
10:11:00 It will involve any number of things, not the least of which
10:11:03 our City of Tampa calls convenience yow activity sites and
10:11:07 things like that.
10:11:09 We will also begin discussion as to the cost, and hopefully
10:11:20 typically a year before the event occurs so, the earliest we
10:11:23 can be discussing it in preparation for hosting year 2019.
10:11:27 To give you an idea of context, we just recently started our
10:11:31 discussion for preparation for fiscal year 2017 so it's a
10:11:37 ways off.
10:11:38 And because it's a ways off, we haven't been provided a
10:11:41 decision yet.
10:11:43 We and our partners want detailed estimates for costs.
10:11:48 There's a host committee being formed.
10:11:51 Any number of costs associated with the Super Bowl, of
10:11:54 course, you read the resolutions, indicate that -- and I
10:12:00 quote -- at no cost, liability or responsibility for the NFL
10:12:06 or the team.
10:12:07 So obviously, somebody is going to be paying for it.
10:12:13 I will also remind you that the times have changed.
10:12:19 I want to make this point clear.
10:12:22 Times have changed since very we successfully hosted the
10:12:26 Super Bowl in 2009.
10:12:27 You all we have also done in the 2001.
10:12:31 And since 2009 on the positive side, we hosted very
10:12:36 successful hosted national and of course International
10:12:39 events, the two primary ones, of course, the RNC convention
10:12:44 and the Bollywood award.
10:12:45 I want to reiterate that because we have done it so well
10:12:48 with such big events for so long, we think that bodes very,
10:12:52 very well that the cost that the city will incur when we are
10:12:56 awarded the Super Bowl five years are from now.
10:13:01 On the negative side, of course, things have changed since
10:13:04 we hosted in 2009, also, the terrorism attacks around the
10:13:08 world including here in the United States.
10:13:11 That is undoubtedly to the responsibility for hosting
10:13:17 another Super Bowl here.
10:13:18 And even if we are awarded in 2019, of course, the world may
10:13:23 get changed again between now and then.
10:13:25 So throws a whole lot of unknowns, and it's going to
10:13:28 continue to be a whole lot of unknowns associated with what
10:13:31 our responsibilities are.
10:13:32 >>HARRY COHEN: Ms. Montelione.
10:13:37 >>LISA MONTELIONE: Mr. Rogero, did I hear you say that
10:13:40 because we hosted so many large events so successfully that
10:13:45 the costs would be less to us?
10:13:48 >> No.
10:13:49 Because we have done it so well for so long and such big
10:13:52 events, we think that's going to mitigate the costs
10:13:54 associated with the city.
10:13:55 I won't say the costs will be less, because we don't know
10:13:57 exactly what --
10:13:59 >>LISA MONTELIONE: What I am I'm sorry, what do you mean
10:14:02 mitigate?
10:14:03 >> I'll put it to you this way.
10:14:05 If we weren't so a department at successfully hosting high
10:14:09 profile events we would assume the costs would be more.
10:14:12 But to use the vernacular, this isn't going to be our first
10:14:16 rodeo.
10:14:17 We feel very confident with whatever responsibilities we are
10:14:19 given.
10:14:20 >>LISA MONTELIONE: So up here you say, correct me if I am
10:14:23 wrong, that we already have the ground game in place, we
10:14:26 already have the processes set for from when we did the
10:14:32 other events so we wouldn't be, per se, reinventing the
10:14:35 wheel or starting from scratch in the planning phase?
10:14:38 >> Yes, we wouldn't be reinventing.
10:14:43 >>LISA MONTELIONE: And that saves costs.
10:14:45 >> Yes.

10:16:06 Ms. Mandell, city attorney, has forwarded to you earlier a
10:16:12 notice that was sent, the wrecker companies in Hillsborough
10:16:15 County that are supported by towing.
10:16:19 In short order it was a reminder of this provision.
10:16:23 As to the question that you asked, at the present time I
10:16:27 don't see anything that would prohibit such an ordinance.
10:16:30 So if you would like to give directions for us to come back,
10:16:33 et cetera my understanding that the ordinance that places
10:16:36 that sell alcoholic beverages would place a notice of
10:16:41 ordinance, and we are happy to come back with a draft for
10:16:44 you consider.
10:16:45 If you have any questions we are happy to take that as well.

10:17:00 bringing this up is the hours, what they consent, the
10:17:08 establishment agreed to in order for them to bring in their
10:17:15 alcoholic beverage permit, and every establishment was
10:17:18 different as to how that came about.
10:17:20 So remembering that is supposed to be done when they renew
10:17:27 their license every year with the city, or at least when the
10:17:31 new one comes in, they are supposed to post that placard in
10:17:35 their establishment.
10:17:36 What I was thinking was if this was included in that, it
10:17:41 would reremind the establishment, this is -- this is the
10:17:46 law, this is what you have to do.
10:17:48 Because it is a law that they are supposed to post the
10:17:52 conditions of their agreement to their alcoholic beverage.
10:17:56 And this would also be a condition -- actually it's not a
10:18:00 condition.
10:18:01 It is already on our books.
10:18:03 So we are saying, okay, now you are going to have to post
10:18:06 it.
10:18:06 Is that what we are asking?
10:18:11 >>HARRY COHEN: And this actually came up in the public
10:18:13 comments this morning.
10:18:14 And this is a very good suggestion.
10:18:16 I think that certainly this is inspired by what you just
10:18:21 referenced, the posting of the conditions in the
10:18:25 establishment.
10:18:26 But what I really saw was not necessarily a posting of the
10:18:29 ordinance, but just a sign, a uniform sign that says to the
10:18:34 public, if you cannot operate your vehicle, under city
10:18:40 ordinance, it can be left till the next day without being
10:18:45 towed.
10:18:47 >>YVONNE CAPIN: And it should be posted right next to the
10:18:49 one --
10:18:51 >>HARRY COHEN: Exactly.
10:18:54 >>LISA MONTELIONE: Thank you, Mr. Chair.
10:18:56 So when I read the ordinance, there is an exception, and
10:19:00 it's section 14-48 letter D that says that unless -- I am
10:19:11 not going to read the whole thing, but unless in receipt of
10:19:17 assigned order.
10:19:18 So the owner of the property, or -- such order may only be
10:19:24 signed prior to owner's vehicle and to include -- and by the
10:19:34 property owner or the lessee.
10:19:36 So there are exceptions to the rule.
10:19:40 So I'm afraid that if we put our uniform sign, and that
10:19:46 exception is invoked and the property owner's assigned
10:19:53 orders to remove the vehicle, that we are providing what
10:19:55 could be misconstrued information.
10:19:58 >>REBECCA KERT: It would certainly bring my goal to bring
10:20:01 back something that is not misleading.
10:20:03 I haven't worked out the wording at this point but certainly
10:20:06 we would want to let them know it would be possible to be
10:20:08 towed but it said require that the owner, the lessee of the
10:20:13 property actually signs to have your vehicle towed.
10:20:16 The problem that was occurring that was the basis of the
10:20:18 underlying ordinance was either unauthorized or a general
10:20:22 authorization to if you so a car at 9:00 you can come and
10:20:26 take it.
10:20:27 Or sometimes even I heard that they were completely
10:20:32 unauthorized towing of the vehicles.
10:20:33 That being said, this makes the owner of the property or the
10:20:37 lessee of the property to be responsible to actually
10:20:43 identify the car that is the problem that needs to be towed.
10:20:49 >>LISA MONTELIONE: So if I park my car in a lot throws not
10:20:52 a guarantee that it's not going to be towed because the
10:20:54 owner of the property could go out and gets my license plate
10:20:58 number and make and model of my car and have the tower take
10:21:01 the car?
10:21:02 >>REBECCA KERT: Yes.
10:21:03 >>LISA MONTELIONE: So it's going to be tricky on a uniform
10:21:06 sign to make that clear?
10:21:09 Because I don't want to promise something to the general
10:21:12 public that we can't promise, that no one is going to get
10:21:18 your car.
10:21:19 But I don't want to get too in the weeds with that.
10:21:23 So we have an ordinance in the books, 14-48, wrecker
10:21:29 regulations, and that is part of that regulation.
10:21:32 So you would be coming back with a separate ordinance that
10:21:34 just speaks to the signage that would be put in the -- and I
10:21:38 would prefer it to be outside, and somebody said, I think
10:21:41 Ms. Capin, I would prefer it to be outside in the parking
10:21:44 lot itself, because if you put it in the establishment, you
10:21:47 never know if anybody is going to see it.
10:21:49 So just the same way that parking lots have signs, that say
10:21:55 if your car is towed, this is the wrecker company's phone
10:21:59 number to call, then having a sign that would be in the
10:22:03 parking lot to tow people -- tell people that they can leave
10:22:08 their car there.
10:22:09 >>REBECCA KERT: We do believe finance this is something
10:22:12 City Council wants to do, we can bring it back and if City
10:22:14 Council wants to make changes or as proposed anything that
10:22:18 is correct would help --
10:22:20 >>LISA MONTELIONE: I am just giving direction of what I
10:22:22 would like to see before you write the ordinance.
10:22:24 A lot of times the legal department says we didn't have
10:22:26 enough direction.

10:22:31 I am not -- I am going to bring up a request for legal to
10:22:36 collect on people that are getting towed, and inside for
10:22:40 expired tags which sometimes the tags are not expired.

10:22:49 exception, maybe we can add that the owner can seen to have
10:22:58 it removed after 3 a.m.
10:23:00 So he's going to come back to his business and sign for it,

10:23:10 At 10 p.m. he can sign for it.
10:23:13 But at 3 a.m. after it's closed or something like that, it
10:23:17 would be definitely on the owner and the lessee of that

10:25:31 City of Tampa how they operate within their premises.

10:25:36 So the question really -- the issue really is, they have to
10:25:39 deal with TECO on that particular issue.
10:25:42 If you want a banner on a city pole or city right-of-way you
10:25:44 simply come in for a permit and you get it.
10:25:47 So we have no say really on the sole source, if it is a sole
10:25:51 source with TECO, but that's something they have to deal
10:25:54 with TECO about.

10:26:04 forward with this, we knew that.

10:26:07 Because this board, this council, when it was brought forth
10:26:11 the first time, said, okay, go back, study it and come back

10:28:58 Because we did that with STP partners for diversity reasons,
10:29:08 and the STP partners took our advice, and are, to my
10:29:14 understanding, utilizing a similar procedure to the city's
10:29:20 procedure for procurement purposes.

10:29:26 were able to negotiate with them.

10:30:11 are familiar with the franchise agreement.
10:30:13 There was a very large contingent of people, and I was one
10:30:18 of them, who protested this franchise agreement, and we were
10:30:21 not happy with the franchise agreement, but the council at
10:30:24 the time went ahead and passed it without the previous
10:30:27 administration of TECO, not who is sitting in the leadership
10:30:32 chair now, I'm trying to say it was not Mr. Gillette who is
10:30:38 here, but a representative from TECO -- and I remember it
10:30:41 like it was yesterday -- stood up in the room and basically
10:30:45 told the council that was sit here that if you don't approve
10:30:48 this franchise agreement we are not going to fulfill the
10:30:50 agreement on the waste to energy plant and made an outright
10:30:55 threat in the middle of the room without being in the
10:30:56 podium, stood up in the back of the room.
10:30:58 So if we have an opportunity to open up that franchise
10:31:02 agreement, you know, I would be happy to open up that
10:31:05 franchise agreement.
10:31:06 I just don't think we need to go that far.
10:31:09 I think if we write to TECO and we ask TECO, we send a
10:31:13 letter under the chairmanship asking that they have a
10:31:18 competitive bid process, or something what we did with STP
10:31:26 partners, as a gentleman's agreement, if you want to use
10:31:28 that phrase, to use a procurement process, because whether
10:31:32 or not those poles are in our right-of-way, in the best
10:31:38 interest of the city, I think, to give a fair competitive
10:31:43 process, and if we don't have any control of what goes on
10:31:47 those banners, could somebody put -- not that I think TECO
10:31:52 is going to make a terrible decision, but could somebody put
10:31:55 something objectionable on those poles that we have no say
10:31:57 with it?

10:39:28 Major Lee Burkoff, Tampa Police Department.
10:39:34 In the City of Tampa from Hillsborough Avenue north all the
10:39:37 way up to the City of Tampa and I am here to discuss the
10:39:41 plan of attack on Seminole Heights and illegal activity in
10:39:44 the alleys and out in the open.
10:39:47 Chief Ward, when he first became chief, made it one of his
10:39:51 three priorities of improving the partnership with the
10:39:53 community, and part of that, in my district he formed a new
10:39:57 squad, and the squad's function is solely that, to work with
10:40:01 the community on problem-solving projects.
10:40:07 It has taken effect at the end of January and has since made
10:40:10 some remarkable improvement in that community.
10:40:12 Just to give you a quick idea of what this squad is, it's a
10:40:15 hand selected squad that have a knack for working with the
10:40:19 community, supervision of the officers.
10:40:23 We have added on that squad a neighborhood affairs liaison
10:40:26 position and our crime free officers that work in mostly
10:40:31 housing communities.
10:40:32 In addition to that, we asked the squad to go out and be
10:40:35 ambassadors to the police department and for the profession.
10:40:40 So since the last 45 days, we have increased patrols in this
10:40:45 area and issued over 28 press pass warnings, and we have
10:40:50 done over 15 street checks on prostitution related
10:40:53 activities.
10:40:54 And a street check would be a police encounter with a known
10:40:57 offender, in particular in this case a known prostitute.
10:41:03 Working with the community in this case, Hampton Terrace has
10:41:06 actually given us quite a bit of intelligence on some of the
10:41:09 prostitution activity in the area which has resulted --
10:41:14 actually resulted in the arrest of a prostitute that was
10:41:17 made in an existing unrelated violation law.
10:41:23 In working with the homeless shelters in the area and
10:41:25 working with neighborhood enhancement, neighborhood
10:41:28 enhancement has patrol officers that work in that area and
10:41:33 we have assigned police officers to work hand in hand with
10:41:36 the code officers.
10:41:37 Just in that area alone neighborhood enhancement had seven
10:41:41 projects which have removed 25-tons of trash and debris from
10:41:45 the alleys and rights-of-way and they have another project
10:41:48 set for this Saturday in the alleyways north of
10:41:50 Hillsborough, south of Hanna between Nebraska and 22nd.
10:41:54 On top of all that, Chief Castor, when she was here,
10:41:59 instituted a PEZ program which I will highlight up here.
10:42:05 If you recall, the PEZ program is a condition of probation.
10:42:11 If somebody is arrested for a felony violation that has a
10:42:15 prostitution history, the judge and/or state prosecutor can
10:42:19 recommend a condition of felony probation, and the
10:42:22 condition, and highlighted here in yellow, which prohibits
10:42:27 them from being in this area unless approved by the
10:42:30 probation officer.
10:42:32 So on this list that we have, we have over 20 prostitutes
10:42:39 with this probation condition.
10:42:42 And to date we have four that are in jail and we have four
10:42:46 that have active warrants.
10:42:48 So one thing that we are looking to do is share this
10:42:51 information with the neighborhood watch so they have the
10:42:55 intelligence so they would say known prostitute X who has a
10:43:00 condition or has a warrant out on the street, and they can
10:43:03 be our eyes and ears for us and give us that information
10:43:06 when we are not there.
10:43:09 So year to date in this particular area that I am
10:43:12 highlighting, prostitution complaints are down 14%,
10:43:27 Any questions?

10:43:30 In terms of the area we are talking about, mostly along the
10:43:35 Florida Avenue corridor is what we are talking about?
10:43:38 In terms of where we are seeing it more prostitution,
10:43:46 alleys, primarily is Hillsborough and Nebraska areas?
10:43:50 >> Primarily Nebraska.
10:43:52 >> because you were mentioning the Hillsborough Avenue
10:44:03 corridor, because that was a place that many years ago you
10:44:06 would see a lot of prostitution in addition to Nebraska and
10:44:10 other places and a lot of people would be surprised to know
10:44:13 that Dale Mabry was a place where there was a lot of
10:44:16 prostitution when I was much younger with.
10:44:18 So things change.
10:44:19 Things stay the same in some ways.
10:44:21 Maybe the oldest profession is called that because it still
10:44:23 keeps going.
10:44:24 In terms of that PEZ project that you have, they are not
10:44:30 supposed to go back into that area except for those things
10:44:36 that you had --
10:44:37 >> If there's employment or going to a pharmacy, but they
10:44:40 would need to consult with their probation officer.
10:44:45 >>MIKE SUAREZ: How do we track Johns, people that are
10:44:47 caught in those areas that are then arrested for
10:44:49 solicitation, soliciting prostitutes?
10:44:52 >> Tracked through our arrest management system of an
10:44:56 arrest.

10:45:02 anything else like other jurisdictions have?
10:45:05 >> When we do operations like that, occasionally we will
10:45:06 bring the media.
10:45:07 Actually, when I was a plain clothes sergeant I did that.
10:45:12 >>MIKE SUAREZ: How successful was that in getting Johns not
10:45:17 to show up in the area again?
10:45:19 >> Surprisingly, would you think that would be a deterrent
10:45:23 but in my experience it hasn't been a deterrent.
10:45:26 >> I was curious about that because I know a lot of
10:45:30 jurisdictions promote that, they brag about it, they put it
10:45:32 out there.
10:45:33 It wasn't sure how successful they were in terms of making
10:45:35 sure people don't Don the same crime over and over and over
10:45:38 again.

10:46:43 There's a lot of things in the TPP like a lot of other trade
10:46:46 agreements that have come before us.
10:46:48 And I will say this to my friends here from the labor
10:46:51 movement who I support, and I know support me, that although
10:46:55 this may be a resolution by us to the administration, right
10:47:00 now, we do not have a solid ground of what's going to happen
10:47:05 with it with and my guess is it's not going to be voted on
10:47:11 anytime soon, at least not until after the presidential
10:47:14 election that's coming forward.
10:47:16 Having said that, the other portion of this is that I think
10:47:19 sometimes this is not a critique, it's more of a gentle
10:47:24 suggestion, that a lot of these trade agreements, although
10:47:26 they are part of what happens with labor in terms of eroding
10:47:31 it, and we all know that labor is really the backbone of the
10:47:35 middle class, has always been sensitized probably from the
10:47:38 1950s when it really became strengthened after all the
10:47:41 fights in the 20s, 30s and 40s.
10:47:43 But it's not the only solution.
10:47:45 I think we need to make sure we understand people that look
10:47:48 at labor, that there are many more things that we need to do
10:47:52 to make sure people understand whereby labor stands with our
10:47:56 economy, how important it is, and how we need to strengthen
10:47:59 labor before we can go forward.
10:48:01 So even though this resolution, I think, is going to pass --
10:48:04 I don't doubt that -- that I think we need to really
10:48:07 concentrate on those things that we can do both locally to
10:48:11 help support people who want to get into a trade, to learn,
10:48:16 to get apprenticeships.
10:48:18 Think we all supported some apprenticeship programs.
10:48:22 I know I have.
10:48:22 And we continue to do that.
10:48:24 Because the only thing that's going to strengthen labor,
10:48:26 these resolutions, although good, aren't really the thing
10:48:30 that's going to bring back labor, and I hope the people that
10:48:33 understand this and who understand what labor actually means
10:48:35 to our economy speak up and talk to the labor leaders, and
10:48:39 labor leaders talk to normal lay people to make sure that
10:48:42 they understand that labor is not an enemy of anyone,
10:48:46 whether it's our economy or anything else.
10:48:49 But a friend that can help actually increase the labor force
10:48:54 and make it better for all of us.
10:48:56 Having said that, chair, I think Ms. Capin is going to make
10:49:00 the motion.

10:49:10 I want to address one comment made earlier and one that the
10:49:14 mayor made in an interview, and that is, has anyone read the
10:49:20 agreement?
10:49:21 The agreement is 492 pages.
10:49:27 I believe either 29 or 30 chapters.
10:49:30 And I would ask -- you don't have to answer that because we
10:49:39 are having a conversation -- but anyone who challenges us,
10:49:42 have you read the agreement?
10:49:43 I would counter that with the same question.
10:49:46 And you know how I like to read everything.
10:49:48 And, no I have not read the agreement.
10:49:52 I have read summaries of the agreement.
10:49:54 And I have had briefing from labor about the agreement.
10:50:00 I haven't had briefings from anyone on the other side.
10:50:03 So in all fairness, I would like -- and I am surprised no
10:50:07 one is here this morning that spoke during public comment,
10:50:12 because if there are members of the community, support was
10:50:18 mentioned in previous conversations, or it was mentioned in
10:50:22 other speeches that have been made or comments that have
10:50:25 been made, no one from the port is here this morning.
10:50:30 And I would like to talk to somebody at the port.
10:50:32 So as Mr. Suarez indicated, this is not necessarily a
10:50:37 time-sensitive issue.
10:50:39 So to be fair and balanced, to borrow a phrase, I would like
10:50:46 to speak to, you know, other people.
10:50:48 And I would like to read the 492 pages so if somebody
10:50:52 challenges me, how can you oppose something that you haven't
10:50:55 read, I would like to be able to say, I read the agreement,
10:50:58 and these are my concerns, and be able to be say that.
10:51:02 So with then diligence of the maker of the motion if I may
10:51:06 ask for another week so that I could be read this agreement,
10:51:08 and I can talk to some other people.

10:55:45 report on the MANCON contract.
10:55:53 We have a brief Power Point presentation to share with you
10:55:57 if I can have that brought up, please.
10:56:01 Okay, the contract has been in place a year this past
10:56:06 January, and we wanted to give you some highlights and some
10:56:10 results.
10:56:13 Prior to the MANCON contract, we had about eleven contracts.
10:56:18 So we have gone from eleven contracts down to one.
10:56:24 With some benefits, not having to bid for several contracts.
10:56:31 In addition to not having to process multiple invoices and
10:56:33 purchase orders for all those associated contracts.
10:56:43 MANCON is able to shop at any time.
10:56:48 And seeing the benefits not only on cost savings but also in
10:56:52 terms of immediate parts.
10:56:55 We also committed to council, a question I believe asked by
10:56:59 Councilman Suarez, to hold the existing inventory on hand
10:57:03 that went from the city ownership to MANCON.
10:57:08 About $287,000.
10:57:10 We have done that.
10:57:10 None of those parts everybody sold externally.
10:57:17 They are kept internally for the city's use.
10:57:20 We did agree to a deadline on when those parts would be
10:57:23 moved out of the city's inventory system.
10:57:26 We agreed to keep them one year and I will give you more
10:57:28 information on that in a moment.
10:57:30 We are going to be talking about MANCON about the parts not
10:57:33 sold that were part of the city's inventory. You may recall
10:57:36 they actually purchased those parts.
10:57:41 This chart basically compares the costs where the city has
10:57:46 the parts operation versus the MANCON, and you can see there
10:57:50 were several months in which the city had some higher
10:57:55 inventory levels versus MANCON, and that's because MANCON
10:58:02 actually allows the city to pull the existing parts we had
10:58:06 on hand.
10:58:06 We had 77,000 still on hand.
10:58:10 We have used the vast majority of the parts that MANCON
10:58:13 actually purchased from the city.
10:58:17 We have also gone from a demand rate of 44% when the city
10:58:22 was running the operation to about 99.5% with MANCON.
10:58:30 That means that we have gone from availability of 44% to
10:58:32 almost 100% in terms of parts availability for this
10:58:36 particular operation.
10:58:39 In terms of non-stock items, anything not on the shelf,
10:58:43 MANCON was able to satisfy that need within one day 89.05%
10:58:49 of the time, and within three days 94% of the time.
10:58:53 And MANCON has purchased at their expense and inventory
10:58:59 roughly $650,000 in parts which the city did not have the
10:59:06 funding to do.
10:59:07 So this particular chart shows you what -- shows you what
10:59:10 the inventory was, the operation in 2014, compared to
10:59:14 MANCON, for the full year 2015.
10:59:18 When the city had it, we roughly spent about $4 million in
10:59:22 parts.
10:59:23 MANCON, 3.4 million.
10:59:27 So in terms of cost savings, the 2014 average expenditure of
10:59:31 parts, the city has about 20.50.
10:59:36 2015 out of the MANCON contract, the average expenditure for
10:59:41 parts is $26.21.
10:59:43 The cost is roughly 8.04%. So we have immediate
10:59:48 availability of parts.
10:59:48 Because MANCON was able to stock roughly 650,000 in parts
10:59:53 versus the city's 287,000. With that I'll be happy to
10:59:59 answer any questions.

11:00:05 I just have a statement to make of myself because I try to
11:00:07 understand and balance these things out and it's very
11:00:10 difficult for me to understand in a way, how can a company
11:00:12 who says they charge nothing above cost, if I remember that
11:00:16 contract -- I haven't read it in over a year -- how can they
11:00:19 get a better price and a better cost, either that or I did
11:00:23 one hell of a terrible job in managing the city and having
11:00:26 parts in stock, either somebody was stealing them or they
11:00:34 disappear on their own out of reverse osmosis, and they are
11:00:37 just not there and we paid for them.
11:00:39 Does MANCON pay any rent to the city for where they are
11:00:43 located at?
11:00:44 >> MANCON does not pay any rent to the city.
11:00:49 >>CHARLIE MIRANDA: So that is a benefit to MANCON.
11:00:52 >> The city is also getting a significant benefit as well.
11:00:57 >>CHARLIE MIRANDA: So that 8% and in logical management of
11:01:02 a business is not really a reality because so of those costs
11:01:04 we inherited by not charging rent.
11:01:06 >> We also had employees running the operation.
11:01:10 >>CHARLIE MIRANDA: Now we are getting to the truth.
11:01:12 >>GREG SPEARMAN: We don't have a huge investment of parts
11:01:15 on the shelf because the city could not afford to do that.
11:01:20 MANCON is able, Councilman Miranda, to buy these parts at
11:01:23 significant volume and get quite a discount that the city
11:01:27 wasn't able to do.
11:01:29 That's where the savings actually comes in.
11:01:30 Because they are a big company that has operations in other
11:01:34 parts of the state.
11:01:36 They can negotiate and buy parts in huge quanty, and at a
11:01:40 discount that the city would never be able to do because we
11:01:43 simply don't have a need for that type of volume.
11:01:46 They pass it onto the city.
11:01:49 >>CHARLIE MIRANDA: We never thought of making some agreement
11:01:50 with different states, counties, other cities, to buy parts
11:01:55 and share it?
11:01:56 We never did that.
11:01:57 But we do it in computers and different things.
11:02:00 So what I am saying is we never looked at a bigger picture
11:02:03 that's here.
11:02:04 And my problem is that I am having an outside company, which
11:02:08 I don't do it with anyone else that I know of -- maybe I am
11:02:11 wrong, and I am going to say that, maybe I am wrong because
11:02:14 I am making a statement without facts -- that goes into a
11:02:20 city building, uses the city facilities, and pays no rent,
11:02:24 none.
11:02:25 And to me, I don't even know if that's legal.
11:02:28 And I am not talking to you, Mr. Spearman.
11:02:31 I like you.
11:02:31 I think you do one hell of a job.
11:02:34 But in reality, what is going on that I do not charge
11:02:36 somebody?
11:02:37 I charge somebody when I pick them up in a ambulance and
11:02:40 take them to the hospital.
11:02:41 And here I am, big company, you said it, worldwide company,
11:02:46 got lots of money, makes money without paying rent.
11:02:50 That's what bothers me.
11:02:53 And they are using the same vendors the city was using.
11:02:56 So either I was overcharged by the vendor, or something is
11:02:59 going on.
11:02:59 I don't know.
11:03:01 I don't have it figured out really.
11:03:02 But I'll try.

11:03:08 One of the things that Mr. Miranda has gone to, you are
11:03:12 having an 8% savings since the contract began, if I read
11:03:16 your numbers correctly.
11:03:18 If you could, go back to your last slide, if possible, Mr.
11:03:22 Spearman.
11:03:31 The guys in the back will work with that in a moment.
11:03:34 With the 8% savings -- and I think Mr. Miranda is saying we
11:03:40 are not measuring the amount of money that is saved for
11:03:43 overhead for a company that is providing these type of
11:03:46 parts.
11:03:47 For example, by getting the free rent -- and it's free or
11:03:50 trade-off, you can call it anything you want.
11:03:52 There is still a differential there.
11:03:54 If I had a regular business, I have to pay that overhead, I
11:03:58 have to pay all the other stuff.
11:04:00 Now, there's cost differential.
11:04:03 I don't know if it's a 3% difference, a 5% difference for us
11:04:06 providing that free space for them to use.
11:04:09 The question I have is this last bullet point, which is
11:04:12 immediate availability of parts.
11:04:15 And try to understand this.
11:04:16 You said it more than doubled.
11:04:21 Is that the amount of parts that are on call at that moment,
11:04:25 or when we purchase?
11:04:26 Because as an example, they were supposed to use the amount
11:04:31 of inventory we have already paid for and we had in stock,
11:04:35 and it looks like based on what you had, they are using --
11:04:39 have used a good portion of it, because we only have about
11:04:43 $98,000 worth of parts left if I read your slides correctly.
11:04:48 So what is this immediate availability of parts?
11:04:50 I need to understand that, because the numbers don't add up
11:04:53 in my head as to what you said.

11:05:09 So they have made an attempt to make sure that they have

11:05:45 that we are able to provide on a one own day service, or
11:05:49 that-day service, that's why it's gone up to 98%?

11:05:58 savings, and maybe we can make a motion to come back and
11:06:00 figure it out.
11:06:01 It seems like -- although I am not -- I try to do
11:06:06 rudimentary type of things but the mathematician is Mr.
11:06:09 Miranda.
11:06:09 He really knows how to do things in his head.
11:06:16 You know, 8% doesn't seem like a whole lot, when you have
11:06:19 that many more parts available to us, in a one-day service,
11:06:23 there's going to be a cost savings for having them there at
11:06:26 the time we need it.
11:06:27 In addition to -- because we are talking about lost time,
11:06:30 all the other things.
11:06:31 So the purchase price may be -- should be less regardless
11:06:36 because of economies of scale, and that we all understand
11:06:40 that, and it's reasonable to be think that they would be
11:06:43 able to buy at coast or from the wholesaler a much better
11:06:46 price than we could as a retail price or even if we went
11:06:50 into contract with some other folks.
11:06:52 So we need to really get down to the NUB of this in terms of
11:06:57 what that percentage actually means, because if it's just
11:06:59 the part, that's one saving.
11:07:01 But they also have some -- we also have some costs borne by
11:07:06 virtue of the rent and some other things.
11:07:08 We need to look at what that total amount is, both it the
11:07:11 net in what we pay for, for parts, and the amount of money
11:07:14 that we are expending per se, but just that we are letting
11:07:19 them use our facility and having that availability there.
11:07:22 Because now that $640,000 worth of parts that they do not
11:07:27 have to house, that they can use those facilities in other
11:07:31 parts of the country or other parts of the state where they
11:07:33 have availability for other customers.
11:07:36 So if you follow my reasoning, I hope you do.
11:07:38 And wail do at the end of this discussion is make a motion
11:07:41 to maybe come back to clarify that from MANCON.
11:07:45 >>GREG SPEARMAN: And in addition to that, Councilman
11:07:48 Suarez, the parts savings is also the streamline of the
11:07:52 operation, the rate which is now 99% going from 11 contracts
11:08:00 down to one, which means that we didn't have to do 11
11:08:06 separate invoices, on a multiple basis, versus one invoice
11:08:12 per month, it also has an impact in terms of vehicle
11:08:17 repairs, that they have got the parts in place on the shelf,
11:08:23 it has an impact in terms of getting the vehicles repaired
11:08:26 done a lot quicker versus having to stock, source the park,
11:08:31 and the city come back and repair the vehicle.
11:08:33 >>MIKE SUAREZ: And that is my point.
11:08:37 8% for that doesn't seem like a whole heck of a lot and
11:08:40 that's because you are only showing the parts differential,
11:08:43 not more than that.
11:08:43 I would like to see more than that because we did make a
11:08:46 decision to go in this direction for a total savings, note
11:08:48 just a savings on parts.

11:09:15 called it, on demand, you have to keep the money tied up.
11:09:22 Because MANCON is doing the same thing we were doing,
11:09:28 keeping the parts in house.
11:09:30 It's six of one, half dozen of another, and it's very hard
11:09:33 to understand the actual costs of savings when never have we
11:09:40 heard what size building it is, what square footage it is,
11:09:44 what is the normal rent for square footage in an industrial
11:09:47 area, I don't even know if it's water or stormwater,
11:09:52 electric.
11:09:52 I don't know what.
11:09:54 So that's not taken into the cost.
11:09:56 When you do a business analysis and you understand and you
11:10:00 pro forma, all of that has to be figured in to find out what
11:10:04 the real savings is.
11:10:07 The figures might be correct but they are not all aggregate
11:10:10 to the real practice.

11:13:11 system in partnership my colleagues were talking about this
11:13:14 being individual in getting -- expanding opportunities for
11:13:19 work and living wages, and was assumed in that conversation.
11:13:28 And this is an outsourced agreement.
11:13:31 These are not employees.
11:13:34 And I'm wondering, at the time when I think this was
11:13:40 initially outsourced, we were under great financial
11:13:43 constraints here at the city.
11:13:46 We were hoping this was going to save us money.
11:13:50 Excuse me, I have the same allergy problem as someone
11:13:53 mentioned earlier.
11:13:54 And these were janitorial and landscape people.
11:14:06 I know we have landscape people who work for the parks and
11:14:09 rec department because they are the ones who are out here
11:14:11 and take care City Hall and other areas.
11:14:16 So why wouldn't we be utilizing our own people for that
11:14:21 function?
11:14:21 >> We do use a lot of parks.
11:14:27 The medians and facility around the facility.
11:14:30 The DVT employees subsidize the work -- that's not a correct
11:14:35 term, Ms. Montelione.
11:14:39 They work with the watering of plants and stuff in our park
11:14:43 area out and around the trail, they just replaced the plants
11:14:47 with the traffic from the conventions and the local -- the
11:14:54 plants that are out there.
11:14:55 But parks and rec --

11:15:04 And wanting to have individuals with good paying jobs, I
11:15:10 don't know what admin provides for their hourly wage or any
11:15:15 of the details.

11:15:29 He said that he did have concerns that this company was
11:15:42 contract -- I don't know why I am having trouble verbalizing
11:15:45 this morning but his concern was competition.
11:15:47 So there are half a dozen local companies that he mentioned
11:15:51 that provides similar services, and I would like to see our
11:15:56 local companies having an opportunity to provide workers who
11:16:01 have would be fulfilling this contract and the services.
11:16:07 He also mentioned this was a shortened contract because
11:16:12 instead of going the full term that I believe you had
11:16:15 requested or someone from your staff had requested, that it
11:16:19 be a shorter term for this contract because you are looking
11:16:28 at aligning staffing and services through one contract
11:16:31 instead of having two contracts for each.
11:16:34 And in so doing, that might narrow the number of companies
11:16:37 that can be provide both of those services under one
11:16:40 umbrella.
11:16:41 So I have reservations, and I have concerns about the
11:16:45 operation and the direction that we are going.
11:16:50 >> There's two separate contracts that you are talking
11:16:56 about.
11:16:57 The DTZ contract is just for what I stated, the landscaping,
11:17:02 the janitorial, custodial services, the set-up and their
11:17:07 teardown services between events.
11:17:09 The two contracts that you are speaking about, one is for
11:17:15 security services at the convention center and the other was
11:17:18 for advanced ambassador and registration services for
11:17:24 convention delegates.
11:17:25 Those two contracts we have talked about combining into one
11:17:29 RFP to go out into the community with.
11:17:34 And there's two different issues.
11:17:35 And that's the reason I'm a little confused.

11:17:43 I talked to Mr. Spearman he was getting them mixed up.

11:39:21 I'm with the Hillsborough County anti-drug alliance.
11:39:23 And thank you for allowing us to speak.
11:39:26 I wanted to share a little bit about -- and I remember
11:39:33 sharing this a few weeks ago -- but one of the things we
11:39:36 also did about substance use and abuse, and one of the
11:39:43 things we do address are some of those risk and protected
11:39:47 factors related tore either perception of harm as well as
11:39:54 health outcomes.
11:39:55 Just three points I would like to make today.
11:39:57 The first one is the policies that only carry those
11:40:02 financial penalties, certainly they serve a financial end so
11:40:06 we understand the part about the assessment or the fees that
11:40:11 they are assessed.
11:40:12 Our recommendation of course, we have something that may be
11:40:15 a little more comprehensive.
11:40:16 I think 2 majority of the council may be aware of the Leon
11:40:20 county model that really talks about the other supported
11:40:23 strategies that really affect some of the underpinnings of
11:40:27 some of the people that might be cited under this policy.
11:40:31 So that's the second point about having supportive
11:40:34 strategies.
11:40:35 The last point is this.
11:40:37 One of the things is that we provide a tool, a resource,
11:40:42 that really kind of helps address underpinnings for people
11:40:46 that far may use anything, that is an endorsed tool.
11:40:51 It's evidence-based.
11:40:54 Data has been collected, and it also improves health
11:40:58 outcomes.
11:40:58 That tool is called expert.
11:41:00 Now that tool is provided at no cost to community
11:41:03 organizations who desire to implement it, and also to Tampa
11:41:06 residents.
11:41:07 There's no cost to them.
11:41:08 It's a universal screening that can be implemented by people
11:41:11 with basic education in as easy as ten minutes.
11:41:15 We have been doing this before.
11:41:16 It's a model that's already been done, down in Miami-Dade.
11:41:20 For girls has done in the collaboration with United Way.
11:41:24 One of the things we wanted to be sure that all the council
11:41:26 members knew and all Tampa resident and certainly
11:41:30 Hillsborough County understand that we are here to support,
11:41:33 we are here to support those underpinnings, and address
11:41:37 those risk and protected factors for people, Tampa residents
11:41:42 certainly that may be using substances or misusing or
11:41:47 abusing substances.
11:41:48 So know that help is available.

11:42:22 I want to address two weeks ago meeting where there were
11:42:25 statistics given out and the figure of 1900 arrests was
11:42:29 mentioned for city of Tampa marijuana possession and also
11:42:30 paraphernalia, but I checked with Leon county jail,
11:42:35 sheriff's office gave me statistics, and there was only 225
11:42:39 actual arrests meaning that a person was handcuffed, put in
11:42:41 the back of the car, booked, and that's countywide.
11:42:46 So I just want to make the point that not only are people
11:42:48 going to jail.
11:42:50 It's a notice to appear and they do have to go before a
11:42:52 judge.

11:42:57 She went to juvenile drug court and she's doing great, she's

11:43:01 So there are misdemeanor programs that help people.
11:43:04 That being said, the ordinance that you are about to pass --
11:43:07 and I hope you will give it a second thought -- is not, I
11:43:12 feel, in the best interest of our citizens, because of two
11:43:15 reasons.
11:43:15 One, there are unlimited chances.
11:43:19 I reviewed everyone's testimony, every City Council member,
11:43:23 and almost all of you kept saying we want to give a person
11:43:26 who made a mistake a second chance.
11:43:28 I fully agree were that.
11:43:30 But what's second chance? Three, four, five, six times? I
11:43:33 think there needs to be an end to it.
11:43:36 The other is that even with all of these chances, not one of
11:43:40 them includes any kind of education piece, assessment,
11:43:43 treatment.
11:43:44 That's what a lot of these people need to get on the right
11:43:47 track.
11:43:47 I am think you all very noble intentions and you want to
11:43:50 help people to prevent an arrest record which I agree with.
11:43:54 But we want to get them on the right track and change their
11:43:57 behavior so they won't be rearrested again.
11:44:01 And the Leon county model that has been mentioned, I did get
11:44:04 you a copy of this.
11:44:05 We dough have interests here in Tampa to get that program
11:44:09 going.
11:44:10 And you may go ahead and pass this the way it is and I am
11:44:13 just hoping before you do, but treatment agencies would love
11:44:19 to work together to try to implement something that would
11:44:21 actually help the people.
11:44:26 Marijuana is not a harmless drug.
11:44:29 It is really a dangerous drug that is much more potent than
11:44:34 back in the 70s.
11:44:36 Ten times stronger.
11:44:38 So we have edible, we have everything you can imagine
11:44:39 from candy -- it's not -- please keep that in mind, it's not
11:44:48 a harmless substance.
11:44:49 I know we are looking at only this one misdemeanor to give
11:44:52 people a second chance.
11:44:53 What about underage alcohol possession?
11:44:55 An under age 18-year-old can have a can of beer in their
11:44:58 hands and they are going to be arrested and yet a person
11:45:01 with up to have 20 grams of pot won't.

11:45:13 Quite frankly I'm really surprised that none of you are open
11:45:16 minded enough with all the suggestions that have been
11:45:18 brought forward not to reevaluate the citation.
11:45:22 If the intent is potentially to prevent a person for
11:45:26 possessing pot and to save our county money in court and
11:45:30 jail costs, then you need to rethink this.
11:45:33 Drug use impacts any person's ability to get a job far more
11:45:36 than their arrest record.
11:45:38 The problem with the citation, the way it's written, is
11:45:41 numerous.
11:45:42 There's no substance abusing prevention sanctions, unlimited
11:45:46 number of possible citations which is $450 after the third
11:45:50 arrest, and we are giving the key to our city to pot smokers
11:45:54 and drug dealers.
11:45:55 After four arrests, clearly a person is heading down a path
11:46:01 and not toward the path of employment. But the real
11:46:03 question is honor is going to benefit from this?
11:46:05 Not the poor minority people because they won't be able to
11:46:08 afford these fees.
11:46:10 Who is going to benefit?
11:46:12 The people who have the money and are able to buy off these
11:46:14 arrests.
11:46:15 Who is going to suffer?
11:46:17 Our Tampa's community will.
11:46:19 Just like Colorado, we will be faced with increased growing
11:46:23 unemployment problems, increased dropout rates, increased
11:46:26 homelessness, and increased DUI arrests.
11:46:31 Hillsborough as you are well aware has a significant
11:46:34 problems with DUI arrests.
11:46:37 So last time someone on the council mentioned that people
11:46:39 smoke pot, they are not going to drive and kill people.
11:46:44 This is what one person was doing online while he was
11:46:48 driving, and you notice it is a significant problem.
11:46:55 The young girl at the Ulele restaurant, that's her.
11:47:00 Marijuana kills.
11:47:02 I have stacks more of articles just this year of people,
11:47:07 about Tampa wrong way driving which you are all very well
11:47:11 aware of.
11:47:12 Many of those people had marijuana in their systems.
11:47:15 In Washington, with legalized marijuana, their driving
11:47:19 fatality rates doubled.
11:47:22 One accident in Colorado, both drivers were so stoned, they
11:47:27 ran into each other.
11:47:28 Not only did they kill themselves but they left three
11:47:32 children behind.
11:47:32 Drivers strike pedestrians. One died, the other in the
11:47:36 hospital.
11:47:42 The other thing I wanted to mention, someone mentioned they
11:47:45 went to a dispensary.
11:47:49 I went online and looked at the dispensaries about how clean
11:47:54 they were and well regulated.
11:47:56 This is just from some of the ones online. This is one of
11:47:59 my favorite pictures.
11:48:01 Supposedly that's the quality control person.
11:48:03 The owner's son.
11:48:04 There is nothing safe and healthy about legalizing
11:48:07 marijuana.
11:48:08 And when it's regulated it's not regulated very well.
11:48:12 So I really hope you sincerely consider --

11:48:33 And when you put up the article about the young lady who
11:48:37 tragically died, worked at Ulele, her blood alcohol level
11:48:42 was more than twice what the limit is.
11:48:46 So I wouldn't say that her death could be directly linked to
11:48:50 her use of marijuana.
11:48:51 I would say that with a blood alcohol level of twice the
11:48:55 legal limit, you are going to have a problem driving.

11:49:52 opportunity to speak today.
11:49:55 I want to begin with the phrase of choices, the decision
11:50:01 that you passed upon which have consequences.
11:50:06 Sitting in this chamber this morning, there are several
11:50:08 council members talked about compliance with state and
11:50:11 federal laws, having time to read the statute, asks
11:50:19 questions on contract, et cetera, but when it comes to this
11:50:22 specific agenda item, the perception to the public, all that
11:50:27 is thrown out of the window.
11:50:31 The purpose of this ordinance, from what I understand, from
11:50:36 first reading, was to have citizens, the ability to divert
11:50:41 from entering the criminal justice system and to not be
11:50:45 burdened with legal fees and other legal issues that attach
11:50:48 to a criminal record.
11:50:54 Very noble cause.
11:50:56 However, with the controlled substance prevention act,
11:51:01 federal law, which has been substantiated by U.S. Supreme
11:51:06 Court ruling, no state or local jurisdictions regulate the
11:51:11 use, possession, distribution, and specifically as mentioned
11:51:16 at the first reading and public comments, cultivation of
11:51:19 marijuana.
11:51:22 Several comments from council members were made about how
11:51:26 it's illegal for its use, and if -- and this ordinance
11:51:32 doesn't address that.
11:51:33 It only addresses possession.
11:51:37 Still federal laws control.
11:51:39 With that said, FBI or any other federal law enforcement
11:51:45 agency has the authority to come in and enforce that federal
11:51:48 law.
11:51:51 With that, citizens or business -- citizens are put in jail
11:51:58 over this potential ordinance, open themselves up to being
11:52:01 not allowed to get federal entitlement programs because of
11:52:08 drug use.
11:52:10 Also, the state attorney here in the 13th circuit has
11:52:15 the Constitutional authority to take the list of people that
11:52:19 have gotten this simple infraction, and have them appear
11:52:25 before a judge on a misdemeanor charge.
11:52:28 Thereby thwarting the entire purpose of this ordinance, and
11:52:32 thereby creating additional tax imposed by the city for that
11:52:37 possession of marijuana, because they have to pay the fines
11:52:41 of civil infraction, and on the whim of the state attorney
11:52:45 pay all the legal fees to that criminal charge.

11:53:18 I want to speak very much against this particular ordinance,
11:53:28 and speak really to the possession aspect of it.
11:53:32 We are hearing a lot about, you know, social work and
11:53:35 intervention and things like that.
11:53:40 And I'm my own attorney, I'll remind you in county court,
11:53:43 circuit court and federal court, and I want to remind you
11:53:48 last year when the "Tampa Bay Times" broke the story about
11:53:50 the disproportionate number of bicyclists being given
11:53:53 tickets, arrested, confiscation of their particular bikes
11:53:57 and possession, that were African-American over 80%, and the
11:54:03 mayor and at that time the police chief Jane Castor
11:54:07 contacted the U.S. Department of Justicer to investigate
11:54:12 their own police department, as if the mayor Bob Buckhorn
11:54:17 didn't already know that stuff.
11:54:18 And since then we found out that people getting tickets for
11:54:22 seat belts.
11:54:23 Over 75% African-American.
11:54:27 Then we find out the ones that getting the criminal charges
11:54:30 with possession of both cannabis, marijuana, pot, large
11:54:36 number, African-Americans, poor.
11:54:38 And we know that the Tampa Police Department, this federal
11:54:42 investigation is going on even now.
11:54:45 And we know that the poor and homeless have been targeted, I
11:54:50 know over 22 years here in Tampa by the Tampa Police
11:54:53 Department and a series of mayors including Mayor Bob
11:54:58 Buckhorn that crafted this diabolical plan.
11:55:00 And I want to share this with you, that a particular aspect.
11:55:04 And we notice the homeless come in all colors.
11:55:07 They are block.
11:55:07 They are white.
11:55:08 They are brown.
11:55:10 They are red and they are yellow.
11:55:13 And this particular ordinance, I want to paint a picture for
11:55:17 you.
11:55:18 You are on the line between in the northern part of the
11:55:22 city, you are on the line where if you cross Fowler there,
11:55:25 you are into the county.
11:55:27 And say you get stopped and the Tampa police check you and
11:55:31 they find that you have got less than 20 grams on you, and
11:55:34 they let you go with a civil ticket.
11:55:37 Okay.
11:55:37 And then they watch you cross the county line.
11:55:40 And they are in cooperation, you know, with the sheriff,
11:55:43 with the Hillsborough County sheriff's deputy, and somehow
11:55:47 they call ahead and they say, you know, had he's got less
11:55:50 than 20 grams, but just up that street in Fowler, in that
11:55:54 neighborhood, now it's a criminal offense.
11:55:57 This should be done at state level legally.

12:03:37 The property is located in the central Tampa planning
12:03:41 district which allows for 25% administrative waiver of
12:03:46 setback.
12:03:47 However, I denied the request based on the property's
12:03:54 location and existing conditions, basically.
12:03:58 This is an aerial.
12:04:01 It's a very long lot.
12:04:02 A double lot.
12:04:05 The survey of this property shows that it extends from
12:04:09 Stanley street to Hollywood.
12:04:12 And it is approximately 53 feet in width.
12:04:15 There is an existing house that overlaps the common property
12:04:21 line of the two different platted lots.
12:04:25 The house was built many years ago.
12:04:28 I believe the property appraisers indicate that it was built
12:04:32 in 1928.
12:04:33 And basically a zero setback on the side.
12:04:37 And again overlaps.
12:04:39 This is considered in zoning as a through-lot since it goes
12:04:44 all the way from one street to the other.
12:04:48 The request for the front and rear yard setback in essence
12:04:55 creates a new lot that would be 53 by 95.
12:05:00 I felt that that was really out of character with the area.
12:05:11 I have a map here that shows basically the pattern of

12:11:50 What we are trying to accomplish here, this creates a lot
12:11:56 that is conforming with the RS-50 guidelines that are
12:12:00 typical throughout the City of Tampa as relates to the R-10
12:12:05 future land use of this property.
12:12:07 We asked for a 95-foot deep lot, which is greater than 5,000
12:12:12 square feet, and in order to be sensitive to the fact that
12:12:17 we have an existing home on the property that we had
12:12:21 asked -- in fact, our original request for the design
12:12:26 exception was design exception 2 and one of the city staff
12:12:31 had tried to streamline the process so as not take City
12:12:35 Council's time with this case, because of the fact that it
12:12:40 could be easily satisfied by design exception 1.
12:12:44 So we actually -- the same as design exception 2 which
12:12:52 requires hearing by City Council.
12:12:54 The house was built in 1928.
12:12:55 It's been recently purchased.
12:12:58 It actually is occupied and is in reasonably good repair.
12:13:02 And that is something that properties along that street are
12:13:09 much older.
12:13:10 This is talking about the Hollywood street.
12:13:12 On Stanley street, and also on the south side of Hollywood,
12:13:16 all the homes are 50 -- actually 53-foot wide.
12:13:21 As noted in Gloria's presentation, the graphics of how
12:13:24 things are laid out.
12:13:25 What we are asking simply is that you be able to do
12:13:29 responsible in-fill development by creating a 5,000 square
12:13:36 foot lot and have a home on west Stanley that is in harmony
12:13:40 with all the other homes on west Stanley.
12:13:43 All the others are 53-foot wide for the most part and then
12:13:46 again on the south side of Hollywood.
12:13:48 The original plats on Hollywood are actually 53-foot wide
12:13:52 lots.
12:13:53 Many of them would be developed as double wide lots.
12:13:56 For example, the lot to the west does not show the location
12:14:00 of the building adjacent to the property line.
12:14:06 That's actually a 100-foot wide lot with 27 wide foot homes.
12:14:13 It's not totally out of harmony within what's going on in
12:14:15 the neighborhood.
12:14:16 In fact it's very much in harmony with what's going on in
12:14:19 the neighborhood.
12:14:20 That's why this appeal to City Council to see if you would
12:14:22 consider this reasonable in-fill development.

12:16:30 rear set back to 15 feet it from 20 feet.
12:16:34 Otherwise they did not meet the minimum lot size.
12:16:38 At a 20-foot setback they did not need it.

12:16:43 greater than 5,000 square feet, you are saying when you
12:16:48 subtract out the setback, it no longer meets the 5,000

12:17:35 preservation of our historic property.
12:17:37 And this is an area where we are looking for density.
12:17:41 We want to encourage density in the parts of the city where
12:17:45 it's appropriate so that we have that problem pens tip for
12:17:50 people to use mass transits or to walk.
12:17:52 It's just a ripe area for the creation of another lot.
12:17:56 And I think that we need to be able to be flexible.
12:18:02 I nor you can't in your decisions be flexible because it is
12:18:09 proscribed by code but that's what we are here for, to add a
12:18:12 little more flexibilities.

12:19:14 In order to be able to keep that 5,000 square foot minimum,
12:19:17 we have to go the 95 feet.
12:19:20 Unfortunately, that 95-foot line whereby you see the
12:19:23 proposed lot line and you see 95 feet at 15.3, that's
12:19:26 actually showing what our rear setback is.
12:19:29 Where it says 15-foot 3 on your paper actually should be 20
12:19:33 feet and that's the issue.
12:19:35 Our design exception is to allow that backyard to be 15 feet
12:19:39 instead of 20.
12:19:39 And that's what we are requesting you do.

12:22:59 I earlier heard about the recommendations regarding the
12:23:05 automobiles, lots at alcoholic zoning but I have also been
12:23:11 informed by certain individual in the area, especially
12:23:13 channel 8, that there's things going on that property
12:23:16 owners -- and I understand property rights -- that these
12:23:20 individuals that have apartment buildings for whatever
12:23:23 reason, sign a contract with a wrecker hauler, and they say
12:23:29 you have an expired tag.
12:23:30 Really nobody really knows if you have an expired tag
12:23:32 because you have the tag but the sticker is missing.
12:23:35 So I can tell you from personal experience that people do
12:23:39 steal the sticker.
12:23:40 And then they come and ticket your car.
12:23:42 In fact the whole City of Tampa ticketed my car.
12:23:46 The problem is that the sticker was stolen.
12:23:48 And the problem is that when I checked I bought that tag and
12:23:52 I had to buy another sticker for the tag.
12:23:54 Thank God I had the money to do it.
12:23:56 But what about somebody that doesn't have the money?
12:23:58 I don't think that anyone in the city other than the police
12:24:00 department, who has the proper equipment, tore check the
12:24:05 tags on location, can tell you if the sticker is in
12:24:09 violation or not.
12:24:10 And the problem is not only does the city, the parking
12:24:14 division -- I don't know if they have that equipment now,
12:24:16 but the apartment dweller owners don't have that equipment.
12:24:21 Again, they are pulling cars out because they say they
12:24:25 violated because of expired tag.
12:24:27 And I don't know, send it to the legal department, see if we
12:24:30 can get a record of some type of ruling on an ordinance if
12:24:34 possible, wherein signs can be posted or something.
12:24:38 We are doing in the bars.
12:24:39 We can do it in apartment houses, I guess, where these
12:24:42 things can't be done unless they have 100% understanding
12:24:47 that that automobile does in fact have expired tags.
12:24:50 A lot of people are being penalized.
12:24:53 One lady was in Venezuela from what the media told me, she
12:24:58 had to fly back, pay about $2,000 to get her car back.
12:25:02 I think that's a crime.

12:25:05 You are saying that people that have expired state license
12:25:08 tags are being towed out from private lots?
12:25:15 >>CHARLIE MIRANDA: Presume that it is expired.
12:25:17 You have a tag that has 15 instead of 16 on it or 14 for 15,
12:25:25 whatever, and they take the individuals steal the little
12:25:28 sticker on your car, and in fact I saw we put the sticker,
12:25:36 get a little raiser blade and cut in the half so they can't
12:25:41 take the stickers and therefore out don't have the
12:25:43 violation.
12:25:43 And all these things were brought up.
12:25:45 It's a situation that I don't have an answer for it.
12:25:47 Maybe the legal department can come up with posting a sign
12:25:51 on that.
12:25:51 If they are going to do that, if they are going to have a
12:25:54 contract with the hauler, at least post a sign.
12:25:58 And I that is the motion.
