05:36:16 request to allow the construction of public service
05:36:20 facilities, specifically the Google communication facilities
05:36:26 connecting fiber-optic cable.

05:36:38 >> I would like to call up Mr. David Hay with Planning
05:36:43 Commission.
05:36:43 >>DAVID HAY: Good evening, council members.
05:36:49 David Hay with your Planning Commission staff.
05:36:51 I have been sworn.
05:36:52 We start up in the university planning district for this
05:36:56 first special use case that was reviewed under the new 2040
05:37:02 comprehensive plan.
05:37:06 257 acres.
05:37:07 The subject site special use is actually .5030 acres for a
05:37:13 360 square foot public facility.
05:37:19 The surrounding area, we have the aerial.
05:37:22 You see the subject site right here.
05:37:25 We have Hillsborough Avenue.
05:37:26 The fire station on Hillsborough Avenue.
05:37:29 A couple of gas stations across the street.
05:37:33 There is residential to the north, and east.
05:37:35 And then there's the mobile home park actually across
05:37:38 MacDill to the west.
05:37:42 Onto the future land use map, you can see the subject site
05:37:46 is right there in the center again, west Hillsborough Avenue
05:37:49 to the south.
05:37:51 The entire parcel, that .85-acre parcel has two future land
05:37:56 use categories.
05:37:57 The southern piece is that community mixed use 35 under that
05:38:01 pink.
05:38:01 And then the northern piece is that residential 10.
05:38:05 Planning staff did review policies regarding public
05:38:09 facilities and did find that the special use request is
05:38:12 consistent with the goals, objectives and policies of the
05:38:15 comprehensive plan.

05:38:19 >> So council, this particular site is existing use, the
05:38:26 fire station owns the property, it's a public use facility,
05:38:30 and the proposed special use is also a public service
05:38:33 facility.
05:38:36 Specifically, the items I think of the general code,
05:38:40 criteria for the public service facility, is that it will
05:38:45 provide communication services underground fiber-optic to
05:38:50 the surrounding area.
05:38:52 It will meet chapter 13 for screening also with an 8-foot
05:39:01 vinyl chain link fence and lastly the structure is very
05:39:05 small.
05:39:05 It's not very obvious.
05:39:09 It's really more like a shed.
05:39:12 And I think it's a tan color.
05:39:16 So it will blend very well.
05:39:20 That's the gist of what we are asking for tonight on this
05:39:22 particular site.

05:39:52 fire station so I think it's very inconspicuous location.

05:43:06 We have got North Rome Circle actually right here.
05:43:11 And then North Forest Hills Drive.
05:43:14 You can see there is wetland areas in the back of the
05:43:18 subject site.
05:43:20 And then to the south you can actually see the pool with the
05:43:23 Forest Hills village, the town home community.
05:43:29 On the other side of north Rome Avenue.
05:43:31 It does have a designated blue color, the public
05:43:37 quasi-public future land use category.
05:43:40 All of that tan around it is residential 10.
05:43:44 Planning Commission staff again similar to the last one
05:43:46 reviewed it against our policies regarding public facilities
05:43:50 and did find the special use request consistent with the
05:43:53 Tampa comprehensive plan.

05:44:44 And it's almost exactly similar to the last application.
05:44:50 Reviewed the application, finds it consistent with the
05:44:53 applicable City of Tampa land development regulation.
05:44:55 The proposed facility building is located adjacent to the
05:44:58 retention area, maintains a 55-foot setback from the
05:45:02 property lying along Rome circle.
05:45:05 I think that's important as well.

05:46:59 It's in the West Tampa area.
05:47:01 The applicant is requesting special use approval to allow
05:47:05 construction of a 360 square foot public service facility
05:47:08 building to install communication facility for connecting
05:47:14 fiber-optic cable placed underground.
05:47:19 It is almost on the exact east side of the West Tampa water
05:47:24 tower.
05:47:25 And I'll show you the aerial.
05:47:38 This is Himes Avenue to the west.
05:47:42 Spruce Avenue to the south.
05:47:44 I will move this up a little bit.

05:47:49 Tampa 360 square foot facility would be in this vicinity
05:47:54 along the south side of the tower.
05:48:01 Like the other two, it will be constructed exactly the same,
05:48:06 flat chain link vinyl, chain link fence with mesh.
05:48:11 Also landscaped to screen the facility.
05:48:23 The staff has reviewed the application and find it
05:48:25 consistent with the applicable City of Tampa land
05:48:27 development regulation.
05:48:28 >>MIKE SUAREZ: Did you want to ask a question?

05:48:35 There's nothing there now?
05:48:37 >> That's correct, it's a wide open field there.
05:48:40 Will be no road constructed through it.
05:48:42 >>YVONNE CAPIN: Okay, when I ask to see a photo of what it
05:48:47 will look like when I met the petitioner refuse, they showed
05:48:51 me a photo and said that that was located where the water
05:48:54 tower is.
05:48:57 What it would look like.
05:48:58 >> Immediately adjacent to it, that would be the south side
05:49:03 of it.
05:49:04 >>YVONNE CAPIN: Is it closed? I mean, this is what was
05:49:08 shown to me when I asked to see a picture they showed me
05:49:13 something and said that's where the West Tampa water tower
05:49:15 is.
05:49:16 And I got the impression --

05:49:24 >>YVONNE CAPIN: Can you answer my question?
05:49:26 >> There were two existing huts that were very similar, what
05:49:29 you saw was the picture of an existing hut that was already
05:49:32 on the site.
05:49:37 And consistent with what exists with than this silver chain
05:49:41 link and open because there are security concerns.
05:49:44 Our understanding is the water district --
05:49:48 >> Water department.
05:49:49 >> Water department.
05:49:51 Has cameras because they want it open and there won't be
05:49:55 landscaping on this site for that reason.
05:49:58 >>YVONNE CAPIN: So there's one there?
05:49:59 >> There are two existing huts.

05:50:03 >>YVONNE CAPIN: So that was an example of what they may
05:50:06 look like?

05:50:16 with them.
05:50:17 When I saw this, it looked like camp Dungy somewhere in the
05:50:24 woods where you go hunting.
05:50:25 And that area there is all redeveloped, houses go from 250
05:50:29 to 300,000.
05:50:30 And I think it's a disgrace to build this type of hut in a
05:50:34 residential that's coming up, that people are going to see,
05:50:37 and it's a disgrace to that neighborhood on that historic
05:50:42 site to do something that doesn't resemble at least the
05:50:46 facade of a house.
05:50:47 And if you want the money I'll give it to you.
05:50:50 But this is just not the appropriate thing to do.
05:50:54 And section 27-129, in 4 and 5, harmony and adjoining
05:51:03 property and the character of the area.
05:51:07 And in five, adverse appearance on adjoining nearby
05:51:11 properties and the character of the area.
05:51:13 Those are the cities of chapter 27-129.
05:51:18 And it might meet the code but it doesn't meet that.
05:51:22 >>MIKE SUAREZ: Before anyone speaks, okay, you have a right
05:51:28 to a certain amount of time.
05:51:29 I would suggest that you wait until after all the
05:51:31 presentation -- all the questions so that you have that
05:51:34 opportunity to answer all the questions.

05:51:53 What is the use of those?
05:51:55 What is the purpose of what is there now?

05:52:08 County sheriff's office and I think the other is actually
05:52:11 part of the water park operations there as well.
05:52:13 So the water department has their hut there and the
05:52:16 Sheriff's Department has their hut there, which is one of
05:52:18 the bigger reasons that they have security cameras both to
05:52:24 protect the Sheriff's Department, and it's a very secure
05:52:27 facility.
05:52:27 As you know it's protected that way.
05:52:29 And the hut is as far back into that facility as it could
05:52:36 be.

05:52:46 Miranda in that we have this historic site and we are
05:52:49 adopting them with what looks like makeshift huts, which I
05:52:52 don't have a problem with in what they are except where they
05:52:56 are.
05:52:59 If they are somewhere like behind the fire station.
05:53:02 But this is not going to have any fence, or anything because
05:53:06 it's not allowed.
05:53:08 Is that correct?
05:53:09 There's no mitigation of the view.
05:53:12 >> Well, our staff states it will be in the site plan,
05:53:21 indicates that it will be a black vinyl chain link fence
05:53:24 with a screen.
05:53:25 So I'm a little bit confused.

05:53:37 I heard that statement, not from you, that the fire --
05:53:43 because it's the water?

05:54:49 Let us go to the Planning Commission colleagues and then go

05:55:03 I will be very brief.
05:55:05 We move down to the central Tampa planning district.
05:55:09 We are familiar that it is the water tower site.
05:55:14 The surrounding area, we have Himes and Spruce to the south
05:55:20 and cherry to the north.
05:55:22 This Himes Avenue corridor is a mix of residential and
05:55:26 office uses.
05:55:27 It gets much more intense south of Spruce.
05:55:32 The WalMart is off the map to the south.
05:55:34 And then we have got single-family detached that is located
05:55:39 to the north and to the east.
05:55:43 The future land use category, again Spruce, Himes.
05:55:49 You can see most of the site is designated that residential
05:55:52 10.
05:55:54 That tan color.
05:55:55 The brownish color a little bit in the front is the
05:55:58 residential 20.
05:55:59 And then we get to more intensive development plan down at
05:56:01 the intersection of Himes and Spruce.
05:56:03 Overall, Planning Commission staff reviewed it, and we did
05:56:09 find the request for the 360 square foot public facility
05:56:13 consistent.

05:56:29 So when the other two were up, specifically the one on Rome
05:56:35 and Forest Hills, the aesthetic issues as well that I would
05:56:44 like to see, but I did not ask those questions because in an
05:56:46 SU-27 process, can we request or can we put conditions upon
05:56:51 the applicant for aesthetics?
05:56:56 >>REBECCA KERT: What you are looking for in the S 2
05:57:01 process, it does include adverse impacts to the surrounding
05:57:05 areas and compatibility issues like you do with the zoning.
05:57:08 Conditions are appropriate but you generally don't place the
05:57:11 conditions.
05:57:13 The applicant can offer conditions and you can accept them,
05:57:17 basically amending the application.

05:57:25 Therefore my statement, maybe there will be some mitigation
05:57:28 on the design.

05:58:05 security reasons mentioned before, the roof line we are
05:58:18 mitigating for other reasons.
05:58:21 And so certainly that's something we are open to discussing,
05:58:26 and can discuss.
05:58:27 And we did feel we were keeping with what was the existing
05:58:35 site structure, the structures on the site, and what had
05:58:38 been required in the past.

05:58:48 And if it's possible I think between first and second
05:58:51 reading there might be able to be some clarification from
05:58:54 the staff that maybe it's possible this landscaping -- maybe
05:59:02 it's possible that they are, you know, hearing our desire to
05:59:06 improve the aesthetics that they might be more open to that.

05:59:17 We can have changes between first and second reading but
05:59:20 whatever those changes are have to be directed by council
05:59:23 tonight so no additional conditions can be made unless
05:59:27 council makes those changes as part of their motion tonight.

05:59:34 were changes it would come back at second reading.

06:10:17 maintain similar appearance to an accessory storage

06:54:12 North on Himes, another single-family residence.
06:54:16 Across the street, also Horatio, another single-family
06:54:22 residence.
06:54:25 And now we are going down who are race job, a series of
06:54:29 single-family developments.
06:54:31 These are one-story or two-story.
06:54:36 Back towards the subject property.
06:54:38 Than the applicant is proposing the creation of two lots to
06:54:47 reestablish as originally plat PD.
06:54:51 The staff report says the lots were platted for lot 21 at 64
06:54:56 by 135.
06:54:58 That is actually a typo.
06:54:59 It should say 54.

06:55:14 As you can see, it's platted at 54 and the other is 54.8 and
06:55:27 they are both by 135.
06:55:28 And originally platted as part of the Parisian park

06:55:42 Because they are wanting to reestablish lots, a total of 97
06:55:54 lots were reviewed.
06:55:57 The tan color are nonresidential lots.
06:56:01 So they are not really taken into consideration.
06:56:05 Of those 51% were found to be conforming.
06:56:07 By conforming we mean they are 50 feet wide or greater.
06:56:11 And then the color blue, or the blue in the red stripe
06:56:18 combo, are less than 60 feet wide.
06:56:22 So for the entire study area, 51% were found to be 60 feet
06:56:30 wide or larger, and then 49% were found to be less than 50
06:56:36 feet wide, which is about even.
06:56:39 For the subject lot, which is this area, you can see that
06:56:45 the subject property is in a row of properties that
06:56:48 currently are already less than 60 feet wide.
06:56:50 So they are already nonconforming with the RS-60 zoning
06:56:53 district.
06:56:55 Only a total of 35% in this entire block is conforming
06:57:00 within the current zoning standard requirement of 50-foot
06:57:04 wide lots.
06:57:08 When consideration -- and again, I reduced a copy.
06:57:16 There is a large grand oak right in the middle of Tampa
06:57:20 property that the developer and the applicant have been to
06:57:23 work around, as it were.
06:57:26 It requires, because of its large size, greater than 30
06:57:30 inches, it's required a 20-foot setback.
06:57:33 As a result, both of the houses will have to be pushed
06:57:37 slightly closer to the property line on the exterior.
06:57:48 They are creating -- or requesting to create front yard
06:57:52 setbacks of 20 feet.
06:57:55 And the rear yards are at least 20 feet.
06:57:57 However, on the side, this side, they are requesting a
06:58:01 6-foot setback, whereas normally it would be required to
06:58:06 have a 7-foot setback.
06:58:08 They are asking for 607.
06:58:10 Again they have to push it over.
06:58:11 And then they are asking for a be 5-foot setback along this
06:58:15 corner yard, which typically again is 7 feet but they are
06:58:18 asking for 5 feet.
06:58:20 Again it's a consideration which they are allowed to do
06:58:23 within the PD.
06:58:24 You are allowed to establish your own setbacks.
06:58:27 For the large tree therein that they are protecting.
06:58:32 There are some changes that staff is requesting to make
06:58:36 between first and second reading.
06:58:40 They are found in the staff report.
06:58:42 One is just the correct use and there's a future land use on
06:58:48 the plan, and natural resources has a couple of existing
06:58:51 trees that they need to clarify exactly what their species
06:58:55 and size are.
06:58:56 So other than that, compliance staff found it consistent
06:59:01 provided that changes are made between first and second
06:59:04 reading.

07:09:05 It is 1.32 acres located along West Kennedy Boulevard.
07:09:09 West Kennedy Boulevard is a transit emphasis corridor.
07:09:13 Urban mixed use 60 and community mixed use 35, and land
07:09:20 uses, a mixed used corridor as well.
07:09:25 There is a transit stop located adjacent to the subject site
07:09:29 at Kennedy Boulevard and Grady Avenue served by route 30 and
07:09:34 in ran evacuation zone.
07:09:36 Here is the aerial of the site.
07:09:40 The surrounding area, strip commercial, offices, restaurant,
07:09:45 low density.
07:09:46 This is Kennedy Boulevard, Grady Avenue, Kennedy Boulevard

07:10:48 As I stated earlier, the subject site is in a corridor and
07:10:53 transit exit corridor as well.
07:10:57 Comprehensive plan is to promote pedestrian amenities along
07:11:02 these areas.
07:11:02 The proposed site plan does include a 10-foot sidewalk along
07:11:05 Kennedy Boulevard which is consistent with the intent of the
07:11:09 mixed use corridors.
07:11:11 This rezoning will also allow numerous updates to this site
07:11:14 which will bring it more in conformance with the current
07:11:16 code, and current comprehensive plan policies that we have
07:11:20 today.
07:11:20 Overall the proposed rezoning is comparable and compatible
07:11:24 to the existing development and it's consistent with the
07:11:27 comprehensive plan.

07:12:13 block, much like we had tonight.
07:12:16 This portion here is currently zoned RS-50 within this
07:12:21 rezoning used for commercial general uses.
07:12:25 This property is also in the Westshore overlay district.
07:12:29 Mike Callahan, urban design professional, is here, would
07:12:32 like to speak as part of my presentation on this as well
07:12:36 when I am done.
07:12:41 They are asking for combination to review the waivers they
07:12:46 are asking for.
07:12:49 Their overall proposal, which I know the applicant will go
07:12:51 into detail, this is the existing building.
07:12:56 They are wanting to do a major renovation on the building
07:12:59 whereby they in effect remove a small section of the middle
07:13:03 of the building and split the building into 2001 pieces.
07:13:08 They will then also do renovations to the inside and bring
07:13:12 it more up to date as the center area will become a patio
07:13:17 area.
07:13:19 And then the parking layout will remain basically as it
07:13:22 currently exists.
07:13:26 Because they are wishing to retain the basic site design,
07:13:31 many of Tampa Westshore -- I am trying to get this better
07:13:35 focused -- many of the best shore overlay standards are
07:13:41 simply impractical.
07:13:42 For example, they are asking for a waiver to increase the
07:13:46 building setbacks from 20 feet to 65 feet, again because we
07:13:49 are talking about an existing building, and it does not have
07:13:54 than the 20-foot setback.
07:13:55 It's substantially further back.
07:13:59 As you can see it's 65 feet.
07:14:01 Another waiver that they are asking for is to permit
07:14:07 reduction of vehicle use and buffer again because we are
07:14:11 talking about repaving the existing parking lot.
07:14:16 The third waiver that they are asking for is when some of
07:14:20 the waivers staff does not support.
07:14:24 And I will get to that right now.
07:14:26 Here is a subject property for Kennedy Boulevard.
07:14:32 Here is the existing sides that on Kennedy Boulevard which
07:14:39 will be considered nonconforming, a nonconforming sign
07:14:43 that's standard.
07:14:45 They would have to be removed.
07:14:50 There are requests to make the signs conforming as part of
07:14:53 the planned development.
07:14:56 It is not -- they are acknowledging these are nonconforming
07:15:02 signs.
07:15:04 There is a nonconforming sign provision.
07:15:09 If they are destroyed or altered, et cetera.
07:15:13 They have to be brought into compliance with the Westshore
07:15:15 overlay.
07:15:16 Here is an existing -- bus stop along Kennedy.
07:15:22 Here is looking down the street which I will show you is
07:15:26 Grady Boulevard.
07:15:29 They are asking for a waiver.
07:15:31 The third waiver is to reduce the required amount of
07:15:34 transparent material from 50% to zero percent.
07:15:39 As you can see it's currently a brick wall.
07:15:41 Again Mike Callahan can speak in more detail to this.
07:15:44 But it's staff's position that doing a major modification or
07:15:49 renovation to the building and removing a central section of
07:15:52 the building, the Westshore overlay criteria that they could
07:15:58 implement to bring the structure into compliance with those
07:16:03 design standards, one of the requirement is architectural
07:16:12 details as well as transparency which they could do, but
07:16:14 they are asking for a waiver from that.
07:16:16 Staff is not supporting that.
07:16:22 It's something that could be considered but they are asking
07:16:24 for a waiver.
07:16:25 Building setback, the building is where the building is.
07:16:28 The parking lot is where the parking lot is.
07:16:30 Okay.
07:16:31 This is further down Grady.
07:16:33 This is the back of the property.
07:16:37 Again, it faces these residential units from North "A"
07:16:41 Street.
07:16:42 There's parking lot back here which they will retain.
07:16:44 But again the Westshore overlay code says there should be
07:16:47 some architectural features because again it face it is
07:16:54 street.
07:16:55 And there are none.
07:16:58 So staff does not support this waiver.
07:17:00 Waiver number 5 in your staff report says that mechanical
07:17:06 equipment should be screened.
07:17:10 The existing building has a lot of mechanical equipment that
07:17:15 staff again feels it should be screened because it's right
07:17:17 across the street from all these houses.
07:17:19 The applicant is asking for waivers to be allow it to remain
07:17:24 as is.
07:17:25 Staff does not support that waiver.
07:17:26 Staff would like to see those mechanical elements on the
07:17:30 roof screened to protect the view from the adjoining
07:17:35 residential property.
07:17:39 Here is going back towards Kennedy on Hill street, the
07:17:44 existing parking lot.
07:17:45 Here is the side of the building on Hale.
07:17:49 Again they are asking for waivers.
07:17:51 We are not supporting that waiver.
07:17:52 We would like to see the improvements of the Westshore
07:17:57 overlay being implemented, transparency with windows and/or
07:18:00 architectural elements.
07:18:08 Than the strip commercial center across Kennedy, another
07:18:11 strip commercial center across Kennedy.
07:18:13 This entire area really around Kennedy.
07:18:18 Across Grady another strip commercial property, commercial
07:18:23 general.
07:18:23 And then directly behind once you get past kind of this
07:18:28 level, you start getting all the residential.
07:18:32 Development.
07:18:33 So here is the residential property.
07:18:37 This is looking down North "A" Street.
07:18:38 This is existing wall.
07:18:42 This is existing wall will remain and actually be improved.
07:18:47 This is looking down north Bay and then all the houses on
07:18:50 the northern side of North "A."
07:18:53 And this is single-family houses.
07:19:03 Shall they are asking for again a number of waivers from the
07:19:08 Westshore overlay that are found in your staff report.

07:19:15 They are asking for a parking lot reduction from 141 parking
07:19:19 spaces to 112 parking spaces, 20% reduction.
07:19:24 Again to reflect the existing height, and existing size of
07:19:31 existing building and existing parking lot.
07:19:36 The existing building is 21,070 square feet.
07:19:41 They are proposing with reconstruction and bifurcating the
07:19:45 building to reduce the total square footage to 19,445.
07:19:52 They are limiting some of the allowable uses within the
07:20:00 zoning district for which they are asking to allow within
07:20:03 the PD, they are limiting the amount of medical office uses,
07:20:07 as well as restaurant uses.
07:20:09 Again typically medical office uses and restaurant uses
07:20:13 require a considerably larger amount of parking.
07:20:15 So they are asking to limit the square footage possible for
07:20:18 those types of uses.
07:20:20 Again, we tried to keep the required or anticipated number
07:20:23 of total parking spaces down.
07:20:28 As far as modifications between first and second reading
07:20:31 they need to update the waiver table. Natural resources has
07:20:36 some clarification as far as some of the trees.
07:20:44 Transportation found it inconsistent for the parking lot
07:20:49 reductions for the number of spaces from 1 had 41 top 112,
07:20:55 20% reduction.
07:20:56 They found it inconsistent.
07:20:58 Again, they need to revise the tree -- the parking table as

07:23:18 fenestration, no windows, no architectural treatment, and
07:23:22 this is pretty much what it is right now.

07:23:28 I want to borrow from a project right down the street also
07:23:33 in the Westshore, which is the Kmart on Dale Mabry and
07:23:41 Columbus.
07:23:42 Look what they did when you told them this is what you have

07:23:46 And that's the Ashley furniture.
07:23:48 And I'm sorry that's a little bit blurry but if you can see
07:23:51 the architectural detail in here, more fenestration, but I

07:26:06 limit the total number of required spaces as well as given
07:26:12 total number of provided spaces.
07:26:14 So there's a limitation about the occupancy and restaurant

07:27:03 They are just taking out the middle section foyer.

07:28:45 Pupello limited investment is an entity owned by several
07:28:48 family members of the Pupello family, and within me is Joe
07:28:58 Pupello, the owner operator.
07:29:02 As the Planning Commission has mentioned, you may recall
07:29:05 back in March of this year, council approved the comp plan
07:29:09 amendment on this site on the north half.
07:29:12 We changed it to residential to commercial.
07:29:15 And at that time we told you the purpose was to allow for
07:29:17 this rezoning request.
07:29:19 So we are back in front of you today to get specific and to
07:29:23 discuss the rezoning.
07:29:24 This rezoning from CG and RS 50 to PD will facilitate a
07:29:31 major renovation of this site.
07:29:35 It will also allow for change of use.
07:29:39 And it will then, the strip center will include not just
07:29:42 retail but restaurant and potentially medical office.
07:29:47 The subject site as you can see comprise it is entire block.
07:29:53 It contains 21,000 square foot building right now.
07:29:57 That building is 48 years old, built back in 68.
07:30:01 Over the years, it's been occupied by various retail
07:30:04 tenants.
07:30:06 And you undergo any kind of renovation, especially of an old
07:30:10 building, you have to deal with a lot of existing conditions
07:30:13 and constraints that you don't typically have to deal within
07:30:16 finance you have a blank slate or you are doing new
07:30:19 construction.
07:30:21 In this case, this building is built structurally sound.
07:30:27 For that reason, the property owners would like to maintain
07:30:31 that existing building.
07:30:34 However, the site is paved.
07:30:39 As you can see from the front to the back and from side to
07:30:41 side.
07:30:42 Has minimal landscaping.
07:30:44 I think maybe two trees.
07:30:46 Than the rear parking area is entirely separated from the
07:30:53 front parking area.
07:30:54 That's the rear parking area.
07:30:56 That's because the building goes all the way across the
07:30:58 site.
07:30:59 There are four access points on Hale and Grady and one
07:31:05 access point on Kennedy.
07:31:07 We have six nonconforming pole signs out front.
07:31:11 One, two, three, four, five, six.
07:31:15 The parking spaces on Grady are in the right-of-way.
07:31:19 And they are going to have to be eliminated.
07:31:23 And then in the rear there's a masonry wall.
07:31:26 Actually that masonry wall isn't on our property.
07:31:29 It's in city right-of-way and it will have to be demolished
07:31:32 and replaced.
07:31:35 I know it was mentioned but we are going to have to be
07:31:38 demolish it and reconstructed on our property.
07:31:42 And as Mike said probably the nicest thing he could say
07:31:45 about this site is it's in need of a face lift and infusion
07:31:50 of new uses and activity.
07:31:54 So with this renovation, not only are we dealing with the
07:31:57 existing site, and existing building conditions, but because
07:32:03 there's major renovation we will also have the more onerous
07:32:08 than have been Westshore overlay standard.
07:32:10 Because of these restrictions and these standards in order
07:32:13 to proceed whenever this renovation, as you heard, we have
07:32:15 to ask for ten waivers.
07:32:16 At first you think that that's a substantial number of
07:32:20 waivers, and seems somewhat out of the ordinary.
07:32:22 But what I believe it should suggest to you is that perhaps
07:32:27 it may not be appropriate to apply the same Westshore
07:32:31 overlay standards to a renovation of an existing building as
07:32:36 you would with to new construction.
07:32:38 We don't have the same design flexibility, so the overlay
07:32:41 standard, I think, contemplated more new construction as
07:32:45 opposed to a renovation.
07:32:48 From fact, the staff on page 6 recognizes the situation, and
07:32:52 they say that recognized compliance from some of the quest
07:32:55 shore overlay design standards are impractical for the
07:32:58 proposed project, building placement, parking lot placement,
07:33:02 given the applicant is proposing to reuse these in building.
07:33:07 With that I am going to turn it over to Randy.
07:33:11 Randy is going to walk you through our site and explain to
07:33:13 you his intent to address some of the waivers, and the
07:33:20 constraints that he had to work under.
07:33:22 And he and Mike did work very closely and cooperatively
07:33:27 throughout this process. I wanted to mention that also
07:33:29 because we do appreciate Mike's cooperation and recognition
07:33:32 of that situation that we are in.
07:33:36 I'll turn it over to Randy.

07:33:43 I have been sworn.
07:33:44 And I am going to move these things out of the way of the
07:33:47 overhead so I can show you some things.
07:33:50 This is the existing site.
07:33:54 As you can tell, it's a very old site.
07:33:57 Over 40 years old.
07:33:59 Just so everyone understands, our property line is the north
07:34:02 edge of the parking lot.
07:34:03 The edge of the building on the east.
07:34:06 Because of the parking lot on the south, the building on the
07:34:12 side.
07:34:13 Basically this side goes to the property line all the way
07:34:15 around.
07:34:16 That's what caused most of these issues and the fact that we
07:34:19 are retaining the existing building on-site.
07:34:22 Under the overlay requires the building to be up front, 80%
07:34:25 of parking to be in the rear.
07:34:26 Things just cannot happen when you have an existing
07:34:29 building.
07:34:30 So we have got an awful long way trying to comply with the
07:34:34 overlay.
07:34:36 This is site plan.
07:34:40 First thing I will point out -- we need to get it a little
07:34:44 smaller.
07:34:46 There we are.
07:34:47 That works.
07:34:50 This is the opening of the building.
07:34:53 We pull out one bay.
07:34:54 That removes 1600 square feet of building.
07:34:57 We'll start with the north.
07:34:58 The existing wall, which unfortunately was built one to
07:35:01 three feet in the right-of-way so it's not to be torn down,
07:35:05 approximately 5 feet in height.
07:35:07 We will be replacing it with a 6-foot masonry wall, pre-fab
07:35:12 panel construction.
07:35:13 We are going to provide substantial buffering along that
07:35:16 area north of the wall.
07:35:17 One of the conditions we have in the zoning is to allow to
07:35:22 have an appropriate maintenance agreement with the City of
07:35:23 Tampa is to provide our buffering outside the property
07:35:27 rather than inside the property since that's just something
07:35:30 that cannot happen.
07:35:31 So on this particular site, which is North "A," with the
07:35:35 residential across the way.
07:35:37 6-foot masonry screen.
07:35:39 Hedges.
07:35:40 Bushes.
07:35:41 Substantial trees.
07:35:42 That's how we are trying to cover up that facade on the
07:35:45 rear.
07:35:45 And that's why we are not looking to screen the mechanical
07:35:48 equipment on the rear.
07:35:50 It's important to note that the parapet walls were on the
07:35:53 east side and west side and the south side of the front of
07:35:55 the building.
07:35:56 Those are existing today.
07:35:59 Where they are actually existing code today.
07:36:04 Do not have a sidewalk across North "A."
07:36:06 We propose one.
07:36:07 City requested that we not construct a sidewalk on North
07:36:10 "A," that we pay a fee in lieu to the city to have a
07:36:14 sidewalk.
07:36:14 We agreed to do that, that allows for much more substantial
07:36:18 and mature plantings in this area.
07:36:21 Trees much larger than the 27 inches required by code.
07:36:26 On Grady, 6-foot sidewalk.
07:36:30 Landscaping to the extent possible.
07:36:32 Sidewalk is up against the street, 6 feet rather than 57.
07:36:35 That's what transportation code requires.
07:36:38 Kennedy Boulevard, 10-foot sidewalk, which is what is
07:36:41 required under the Kennedy he overlay.
07:36:46 Hill, 6-foot sidewalk again, what's required in the overlay.
07:36:49 Very substantial sidewalk.
07:36:50 And we talked about 3-foot sidewalks.
07:36:54 It's Tampa sidewalk within the property that has 3 feet
07:36:56 today and is nothing that we can do about.
07:37:00 We talked about the landscaping.
07:37:02 There are 6 pole signs on the front of the property.
07:37:05 We are removing three of them or 50% of the signs.
07:37:09 In talking with the D.O.T. and going through this process,
07:37:12 the D.O.T. is requiring to us close the driveway on Kennedy
07:37:15 Boulevard.
07:37:16 So we are closing that driveway.
07:37:18 And providing parking.
07:37:21 We will talk a little bit about parking beyond where we are
07:37:23 at today.
07:37:26 Transparency issue.
07:37:29 Yes, absolutely correct.
07:37:31 When we look at the existing elevation, large blank walls on
07:37:35 the east side and the west side.
07:37:38 Elevation, a very new look for the project.
07:37:46 East side and west side providing some transparency where we
07:37:49 can.
07:37:49 Our waiver is to ask for zero because we are into how much
07:37:52 can we do when we start demolishing walls of this building
07:37:55 and putting in glass?
07:37:57 What I would like to show you is what's being proposed --
07:38:00 and we believe we can accomplish -- is on the east side, 12%
07:38:07 transparency.
07:38:08 The code requires 50.
07:38:10 We can do as much as 12.
07:38:11 On the west side, we are providing 18% of transparency.
07:38:16 The code requires 50.
07:38:18 So we have asked for a waiver down to zero to make sure that
07:38:21 we can accomplish what we say.
07:38:24 Let me check my notes for a moment here.
07:38:28 The other thing is of course going back to the site plan and
07:38:35 dealing with parking.
07:38:38 On the existing, we have 11 parking spaces on Grady, so they
07:38:43 are not appropriate parking spaces and we are removing those
07:38:46 in this plan.
07:38:49 The last thing I will talk about a little bit is parking and
07:38:51 the parking reduction.
07:38:53 Remember, this project was built in the late 60s.
07:38:56 It was totally compliant with the zoning code in the late
07:38:59 60s.
07:39:00 It's not compliant with the zoning code today.
07:39:04 Of the 20% waiver we are seeking, 15% or three quarters of
07:39:08 that particular parking waiver is actually what is
07:39:11 permissible in your current zoning code for projects that
07:39:14 were built prior to 1988 under a preexisting zoning code and
07:39:19 parking, so what we are actually asking for is a waiver of 8
07:39:23 parking spaces
07:39:26 The reason for that is mixed use between restaurant and
07:39:29 retail have differing tastes and we know that we have eight
07:39:33 spaces that we can get by with.
07:39:34 However, generally correct from the zoning standpoint today
07:39:38 for a project that was built in the late 60s.
07:39:41 That's why we are requesting a 20% waiver and parking that's
07:39:45 15%.
07:39:46 Put the parking where it's allowed to be in code today with
07:39:50 zoning.
07:39:50 The other 8 spaces are the actual waiver that we are seeking
07:39:54 when you apply those criteria.
07:39:56 With that, I hope to be able to answer any questions you
07:40:00 might have.

07:40:25 We propose to provide a 6-foot sidewalk along North "A."
07:40:29 City staff requested that we not provide that sidewalk, that
07:40:32 we pay an in-loop fee to their sidewalk fund, because there
07:40:36 are no sidewalks along North "A" anywhere in this particular
07:40:40 area.
07:40:40 And they simply felt it was inappropriate, and it did than
07:40:44 allow us to provide a much greater vegetative buffer for the
07:40:48 residents to cross the street.
07:40:50 So we are complying with sidewalk code all the way around.
07:40:55 We have a waiver for a 3-foot sidewalk, on an existing
07:40:58 sidewalk, 3-foot today, and there's nothing we can do about
07:41:01 it.
07:41:02 >>LISA MONTELIONE: The sidewalk but immediately adjacent to
07:41:05 the building you are talking about.
07:41:07 >> yes.
07:41:07 That's correct.
07:41:08 And connections to the public sidewalk, but we are not
07:41:12 trying to avoid sidewalks.
07:41:14 I'm a very strong advocate of sidewalks.

07:41:22 disagree with staff about the in-lieu about the sidewalks,

07:41:35 are homes and people back there, they may be walking
07:41:39 somewhere, and having a sidewalk as opposed to not having a
07:41:42 sidewalk is always nice.
07:41:43 >> And we are paying for a sidewalk to be placed a long that
07:41:47 length of North "A," it may be on a different side of the
07:41:50 street or something of that nature.

07:44:20 blank wall on the other side, and then on the Grady side,
07:44:23 that's what it would be facing opposite it.
07:44:26 So it really doesn't serve much of a purpose as far as
07:44:30 aesthetics.
07:44:31 It's not visible to the neighbors in the rear.
07:44:35 It's blocked by the wall in the parking lot.
07:44:39 The partial transparency that we are providing is the only
07:44:42 portion that is arguably visible from Kennedy Boulevard,
07:44:46 that small portion.
07:44:49 >>YVONNE CAPIN: What is the back of the building to the
07:44:54 neighbors and there's no parapet or nothing to cover the --
07:45:04 >>GINA GRIMES: And on that issue, I think that the staff --
07:45:07 yes, Mr. Callahan thought we were constructing a parapet

07:45:11 That wall is already there on the roof.

07:45:19 And what we were trying to avoid is nip alterations to the

07:45:25 That is one area where Mr. PUPELLA said he would be willing
07:45:32 to compromise and extend that parapet wall that would match
07:45:34 the other as long the back to screen some of that mechanical
07:45:37 equipment.
07:45:39 But the other two requirements for the facade embellishment
07:45:42 and the transparency requirement, first of all, I believe
07:45:45 those are the kinds of requirements that shouldn't be
07:45:47 applicable necessary to major renovation.
07:45:49 Maybe to new construction because you can factor it into
07:45:52 your design.
07:45:53 But here you are talking about forcing alterations to the
07:45:56 building that weren't otherwise planned.

07:46:05 are agreeable to than the parapet covering the appliances.

07:46:11 >>YVONNE CAPIN: And I will tell you, I tend to agree with
07:46:14 you on the -- you have an existing building and everybody
07:46:19 knows when you start digging into them, it can cause myriad
07:46:26 issues.
07:46:27 So I can agree with that part of it.
07:46:30 But the parapet in the back, I think the neighbors deserve
07:46:34 not to look at the appliances on top of the building.

07:46:43 mindful of the fact that a lot of these requirements could
07:46:47 be onerous when you are renovating a building, and I have to
07:46:51 say for me, the biggest issue -- and Councilwoman Capin
07:46:57 alluded to it a moment ago -- is really the landscaping
07:47:00 behind the masonry wall facing North "A."
07:47:03 I think that that's absolutely the most important piece.
07:47:08 It sound to me from what you just said, though, is that you
07:47:11 are willing to screen Tampa air conditioners on the roof,
07:47:17 and you are also proposing son fenestration on the two sides
07:47:21 of the building, 12 and 18 instead of zero.

07:47:35 The most important justification for approval of the waivers
07:47:38 and the rezoning is because allowing this renovation to
07:47:42 occur will result in a dramatic improvement to this site.

07:47:54 building at the fence, how many feet is that? What's the

07:48:02 So I actually discussed this issue with a neighbor that
07:48:06 lives across North "A."
07:48:07 And it's about 37,000 to 4,000 square feet of landscaped
07:48:12 area.
07:48:17 The site is 300 feet wide.
07:48:19 So it's begun 14 by 300.

07:48:27 But keep in mind the improvements that we are proposing to
07:48:30 construct.
07:48:31 We are eliminating that rear dead zone with than the

07:48:35 We are removing three of the six nonconforming signs.
07:48:39 We are removing the Kennedy driveway, installing 6-foot
07:48:44 sidewalks on Hale and Grady.
07:48:47 And representative sidewalks are going to be increased from
07:48:51 5 feet to have been 10 feet.
07:48:52 We are removing and reinstalling the rear wall on the
07:48:56 property, increasing that median and lapped escaped area on
07:49:00 North "A," and we are adding a substantial number of
07:49:02 landscape -- substantial amount of landscaping and trees on
07:49:07 north "A," Hale, and Grady.

08:06:39 Plant Park is the closest public recreational facility
08:06:43 located approximately 720 feet to the northeast of the
08:06:46 subject site.
08:06:48 The subject site is also located right adjacent to Kennedy
08:06:52 Boulevard, a transit corridor, and does have routes 4 and 19
08:07:04 run along the south on West Cleveland Street, while Hart
08:07:08 route 30 runs along Kennedy Boulevard.
08:07:11 The subject site is located within a level C evacuation
08:07:15 zone.
08:07:16 Onto the aerial.

08:07:27 We have got Selmon, Lee Roy Selmon Expressway to the south.

08:07:35 And you all are well aware has a mix of uses.

08:07:47 The subject site and all this area here, that regional mixed
08:07:51 use 100, one of the most intensive land use categories
08:07:55 actually within the west coast of Florida.
08:07:57 So we also have public quasi-public represented by the blue.
08:08:02 Even though these parcels are showing up with all the
08:08:06 expressway to the south.
08:08:08 And then you get on the south side of the expressway.
08:08:11 You get the commercial corridor of Platt and then into the
08:08:15 residential.
08:08:17 That's the south side of Platt.
08:08:20 The applicant is proposing to develop a maximum 314
08:08:23 residential units at 9,048 square feet of general commercial
08:08:28 uses, within a 361,677 square foot mixed use structure.
08:08:35 Parking will be provided within a extraordinary parking
08:08:38 garage, with an amenity on the 9th level of the garage.
08:08:42 With the regional mixed use 100 future land use designation
08:08:46 the subject site and adjacent parcels are expected to
08:08:48 develop in a more urban character within the horizon of the
08:08:53 comprehensive plan.
08:08:54 The proposed density of 314 residential units within that
08:08:59 361,677 square foot structure would provide for development
08:09:05 with a floor area ratio of 3.2, and that's below the maximum
08:09:10 of 3.5 that can be considered under that regional mixed use
08:09:13 100 future land use category.
08:09:15 The development is urban in character, which is oriented
08:09:19 towards adjacent rights-of-way.
08:09:21 There is commercial on Grand Central Avenue.
08:09:23 Parking is also provided within a structured parking garage.
08:09:26 And in a surface parking is being proposed under this
08:09:30 request.
08:09:30 Future residents would also have easy access to be a number
08:09:33 of transit routes and public recreational facilities such as
08:09:38 Plant Park and nearby Riverwalk found within the surrounding
08:09:42 area.
08:09:43 Based upon those considerations, the Planning Commission
08:09:46 staff finds the proposed planned development consistent with
08:09:49 the provisions of the Tampa comprehensive plan.

08:10:31 A look at the existing conditions on-site currently.
08:10:33 Here is the subject property.
08:10:36 Actually, the aerial photograph most of it, actually all of
08:10:43 it except for the northwestern corner, which is an existing
08:10:47 building, the remaining portion is currently a parking lot.
08:10:52 So a parking locality.
08:10:59 This is along Magnolia.
08:11:01 As you can see, there are two existing trees on-site.
08:11:07 This is known as grand tree one.
08:11:10 This is known as grand tree two.
08:11:13 Which are located -- this is one.

08:11:17 One is deemed hazardous, to be removed.
08:11:21 Tree two will be relocated in the general area of tree one
08:11:26 as part of this plan.
08:11:28 And if I may, I would like to -- a little different with
08:11:34 this presentation, allow the applicant.
08:11:40 The applicant is proposed prepared to GOP through the
08:11:44 different proposals and again there's existing parking lot.
08:11:48 Here is an existing structure that will be retained with
08:11:52 this application.
08:11:53 I do want to note and clarify, I called this historic in the
08:11:59 staff report.
08:12:00 It is not a historic structure.
08:12:01 It has not been categorized or defined or designated as a
08:12:06 historic structure.
08:12:07 It is an old structure, but it is not protected or does not
08:12:12 fall in any sort of historic parameters.
08:12:17 Regardless, they are proposing to retain it and allow for
08:12:24 CG.
08:12:25 Here is a shot of the same old building from Cedar.
08:12:33 Again than the applicant is proposing a multi-corridor as
08:12:37 part of this project.
08:12:39 And across the street, across Cedar, is the existing parking
08:12:44 lot.
08:12:45 I do know this area is currently zoned PD and titled for a
08:12:52 large 135-foot garage which hasn't been constructed yet.
08:12:57 This is at the corner of Cedar, and religious assembly.
08:13:03 Turning the corner, place of religious assembly.
08:13:08 Joint parking lot.
08:13:09 And then when you cross Grand Central, you are familiar with
08:13:17 this and also restaurant uses.
08:13:21 Grand Central Boulevard.
08:13:26 Staff has reviewed the proposal, which is what's before you,
08:13:35 which we determined is significantly different from the
08:13:38 previous proposal that you may remember we were using last
08:13:45 year.
08:13:46 And they are currently proposing two residential buildings
08:13:52 that have a extraordinary nine story parking garage.
08:14:01 The existing building, or smaller house which is currently
08:14:07 used as an office building, will be retained within CG uses.
08:14:18 The existing proposed F.A.R., the allowable F.A.R. in the
08:14:22 comp plan is 3.0 with a maximum of 3.5, if you do bonus
08:14:29 provisions.
08:14:30 They are asking for 3.3 so they are required to do than
08:14:34 bonus provisions.
08:14:36 That development agreement was part of the agenda.
08:14:39 But because of notice issues, you moved it forward for first
08:14:43 reading on the 4th and second reading on the 11th.
08:14:46 The parameters for the bonus provisions are structured
08:14:52 parking which they are providing.
08:14:55 And again the applicant will go into detail about how they
08:15:00 will be providing that as well as there's an existing bus
08:15:03 stop here on Magnolia.
08:15:06 They will be providing a shelter and improvements in
08:15:12 coordination with her.
08:15:15 Other than that, as far as staff's review of the
08:15:17 application, transportation found it consistent.
08:15:25 There's some changes that are required between first and
08:15:28 second reading.
08:15:30 Which are to revise the table.
08:15:37 The applicant has submitted a site plan that staff has done
08:15:40 a preliminary review on for transportation issues, zoning
08:15:45 issues, as well as resources issue.
08:15:49 The proposed plan in effect will be switched out between
08:15:54 first and second reading.
08:15:56 There is one note of clarification on the revision sheet.
08:15:59 It says that the number for the one and only waiver needs to
08:16:03 be corrected.
08:16:04 Actually, it is correct as is currently stated on the site
08:16:08 plan and does not need to changed.
08:16:10 The site plan currently stated is section 27-283.15.6. That
08:16:17 is the correct reference.
08:16:19 That does not need to be amended.
08:16:21 Natural resources found this proposal consistent.
08:16:25 They just again have clarifications for the tree table and
08:16:32 the gren space requirement that need to be corrected between
08:16:35 first and second reading.
08:16:37 Again, staff has worked very closely within the applicant to
08:16:39 get those numbers correct, and again they will be changed
08:16:43 out the site plan between first and second reading,
08:16:47 requested compliance with the code requirements.
08:16:50 As I stated, grand tree number 2 will be moved on-site,
08:16:59 staff, natural resources, has worked with the arborist.
08:17:03 Again I believe they are here to speak tonight.
08:17:05 And created a detailed plan about how the relocation of that
08:17:09 tree will occur as far as prepping the site.
08:17:13 The actual relocation process, maintenance of the tree, and
08:17:18 Kathy Beck from natural resources of our department is
08:17:22 available tonight to answer any specific questions with
08:17:24 regard to that.
08:17:26 I will note there are no requests for any waivers regarding
08:17:29 any natural resources requirements.
08:17:31 They are complying with all standards.

08:22:10 Altman Development Corporation in this PD rezoning.
08:22:14 We have three representatives in attendance tonight on
08:22:16 behalf of Altman.
08:22:18 First and foremost, we have Joel Altman.
08:22:21 Mr. Altman is the company founder and chairman, and he would
08:22:24 like to address council at the end of our presentation.
08:22:28 We also have Jeff Roberts. Jeff is the president and chief
08:22:31 operating officer, and he is going to address you at the
08:22:34 beginning of our presentation.
08:22:36 And then we have also Matt bargainae, he has his offices in
08:22:44 Tampa and this is the person that has shepherded this
08:22:47 project through the review process.
08:22:49 I know you all recall that Altman came before you last
08:22:53 September for a PD rezoning on this same site, and as I said
08:22:57 that rezoning was denied.
08:22:59 We were permitted to come back in front of you today prior
08:23:03 to the one-year stay that you imposed following a denial
08:23:07 because the city staff determined that this PD proposal
08:23:12 adequately addressed all of your grounds for denial.
08:23:16 So with that I am going to turn it over to Jeff.
08:23:19 He would like to make a brief introduction.
08:23:22 >> Good evening, council members.
08:23:28 My name is Jeff Roberts.
08:23:30 As Gina indicated.
08:23:33 For the last ten months, since last September, we and our
08:23:37 team of professionals have been working with the neighbors,
08:23:41 the community stakeholders and the city staff to remain
08:23:45 committed to this site, and try to find a way to completely
08:23:51 start from a clean sheet of paper and come up with something
08:23:54 that was really special and something that could be
08:23:57 supported by all the stakeholders.
08:24:00 I think what we accomplished as a group is really something
08:24:06 that we can all be proud of.
08:24:08 And within that than the community support that we received
08:24:12 since we started showing some he will elevations of the
08:24:16 development and the site plan revisions, the changes that we
08:24:19 have made, have just been overwhelmingly positive.
08:24:23 So we are very, very pleased about that.
08:24:26 Just with be that I would like to close, and thank you for
08:24:29 your reconsideration of this development.
08:24:31 We worked very, very hard.
08:24:33 And we are very proud of what we are going to present
08:24:35 tonight.
08:24:36 Thank you.
08:24:36 >> During the public hearing last September, council
08:24:47 identified what I categorized as the six issues of concern
08:24:52 with the previous proposal.
08:24:54 And I am going to begin by discussing three of those six
08:24:57 issues identified by council.
08:24:59 They are whether, we had an issue with the mixed use nature
08:25:03 of the previous PD, an issue with the transit and pedestrian
08:25:08 orientation of the project, and you also had an issue with
08:25:12 the neighborhood compatibility and respect for the community
08:25:16 identity.
08:25:17 As to the first issue, the mixed use nature of the project,
08:25:22 the city staff has already discussed this modified PD
08:25:26 request approval of 314 multifamily units, 9,748 square feet
08:25:32 of commercial uses, and then approval of the site also to
08:25:38 include principle parking.
08:25:41 Altman has increased the commercial square footage by 4500
08:25:45 square feet.
08:25:46 That's an 87% increase over the original PD.
08:25:50 And the intent that was to create a sufficient mixture of
08:25:54 commercial uses in relation to the number of dwelling units.
08:26:00 The portion of the additional commercial square footage will
08:26:03 be located in the Bryn Allen building shown on this
08:26:12 elevation.
08:26:14 In order to -- is the seller in order to proceed with than
08:26:17 this project required -- I'm sorry, Altman required the
08:26:21 seller, in order to proceed with this project, to retain
08:26:24 that Bryn Allen building.
08:26:26 He insisted that it be retained and because of the
08:26:30 sentimental value that it has to a lot of people in Tampa,
08:26:33 being that it was a high school photo studio, now intended
08:26:38 to be redeveloped, hopefully as a restaurant with an outdoor
08:26:42 cafe along the porch area that you see on the front.
08:26:49 The second issue council identified was a transit
08:26:53 orientation of the project.
08:26:55 There are several amenities that we are now proposing that
08:26:58 would qualify the development as transit and pedestrian
08:27:03 friendly.
08:27:05 We have met with Hart.
08:27:06 And the transit stop on Cleveland will be rebuilt entirely
08:27:12 with the typical amenities, the shelter, the benches, the
08:27:16 lighting and the trash.
08:27:18 There is not a lot of right-of-way on Cleveland that we have
08:27:20 to work with.
08:27:21 We may end up relocating that more towards the center of the
08:27:26 block subject of course everything subject to Hart approval.
08:27:30 But in addition to the typical amenities that are provided
08:27:33 in the transit stop, Altman is also agreeing to provide
08:27:38 public Wi-Fi at that transit stop.
08:27:41 We are going to provide a bicycle rack and also going to be
08:27:46 provide a public bike fix-it station.
08:27:49 I am going to show you a photo of in right here, you can see
08:27:54 all the tools and then there's the bike pump right there.
08:27:57 The project will also provide residents of the multifamily
08:28:02 development access to an interactive touch screen, bullet to
08:28:06 board kiosk, which is going to have transit information, and
08:28:10 also information on the routes nearby.
08:28:12 The building has an air conditioned bicycle storage on the
08:28:17 first floor of the building to be promote use of bicycles.
08:28:20 And there is an additional bike rack and another public bike
08:28:26 fix-it station on the corner of Cedar and Grand Central.
08:28:29 As a parking garage will include spaces for electric cars
08:28:33 with charging stations, and there's going to be a car share
08:28:36 option in the garage through enterprise rent a car.
08:28:41 And the streetscape on the subject block will have -- and I
08:28:47 identified it in yellow here -- the setbacks.
08:28:50 They will have wider 8-foot sidewalks, and pedestrian plazas
08:28:55 on Grand Central, and then we will also upgrade the pavers
08:29:00 and concrete.
08:29:01 The third area of concern identified last September was the
08:29:05 neighborhood compatibility and respect for the community
08:29:08 identity.
08:29:09 We will achieve both of those items through both on-site and
08:29:15 off-site improvements and enhancements.
08:29:18 As to the on-site enhancement, the green space was
08:29:23 substantially increased.
08:29:25 We now have two and a half times the amount of green space
08:29:29 that is required by code.
08:29:34 There was a requirement for 4-inch canopy trees along the
08:29:39 site, and Altman has voluntarily agreed -- and we need to
08:29:45 add this to the revision sheet -- to upsize those 4-inch
08:29:49 trees to 8-inch trees, and we are going to provide an
08:29:52 additional -- there's just a photo of an 8-inch tree so you
08:29:56 can see with the tractor here, you can get the perspective
08:30:00 of how large a tree it will be at the time of installation.
08:30:03 But that will provide an additional 68 inches of trees
08:30:07 within our block.
08:30:09 There will also be a neighborhood valet area, which can be
08:30:15 used by any of the other businesses in the neighborhood.
08:30:21 And you can see it right in here, the neighborhood valet
08:30:25 area.
08:30:26 And also there is neighborhood parking available in the
08:30:31 first three floors of the parking garage, including an air
08:30:34 conditioned elevator.
08:30:35 The off-site improvements are constructed -- and they are
08:30:39 being done to establish a commitment total neighborhood.
08:30:43 This will ensure -- they will be ensured through the
08:30:46 companion development agreement.
08:30:48 First, Altman is committing to a tree planting plan along
08:30:54 residential.
08:30:57 You can see there.
08:31:01 They will be installing 18 street trees, and along with the
08:31:09 street trees at the base of each tree they are going to
08:31:11 install this new product which is a flexi pave instead of a
08:31:18 you great and you can see it's impervious.
08:31:22 In addition, have been off-site, they have agreed to a
08:31:28 street lighting plan, ten streetlights will be installed,
08:31:33 mostly on our block but also across the street on the north
08:31:36 side of Grand Central.
08:31:37 You can see wherein I have indicated with the green dot.
08:31:43 We were advised that we need to work with TECO, and this is
08:31:46 TECO list of approved lighting.
08:31:50 And this is the standard lighting that we will go with.
08:31:55 It's referred to as the enhanced classic.
08:31:58 We were trying to going with the U.T. lights but we were
08:32:03 informed that TECO would not approve such lights.
08:32:08 Probably the most notable neighborhood improvement that we
08:32:12 are committing to is completing a much needed renovation to
08:32:22 the park necessary Kennedy Boulevard at Grand Central, rate
08:32:25 at the apex there.
08:32:28 It's going to be substantial improvement.
08:32:30 But Altman has met with the Parks Department, and they have
08:32:33 agreed to do -- to clean the entire area.
08:32:39 There will be fountain repairs.
08:32:42 There will be lighting installed in all the oak trees.
08:32:44 We will replace the irrigation in the existing landscaping.
08:32:48 We will install a green screen onto the existing wall in the
08:32:52 park.
08:32:53 We will add another sign? Park sign, and all the signs will
08:33:00 then be lit, and we will also plant some additional trees,
08:33:05 crape myrtles if there is space available.
08:33:08 The remaining three of the six issues that were identified
08:33:13 in the previous public hearing will be addressed by our
08:33:17 consultants who will provide expert testimony in each
08:33:21 regard.
08:33:21 And the last three issues that they will address are design
08:33:24 and scale, the trees, and parking.
08:33:28 And to begin, as far as the design and scale is concerned,
08:33:34 we have Beatrice Hernandez, the architect for the project,
08:33:39 with NSA architecture.
08:33:42 And I will turn it over to Beatrice.

08:34:15 It was a great presentation but I am going to sort of walk
08:34:18 you through what she talked about, and what the experience
08:34:20 is going to be like for the people coming to the
08:34:22 development, as well as those within the development.
08:34:25 We'll talk a little bit on the site plan.
08:34:27 I know I have a short time so I will keep it brief.
08:34:32 I have never used this before.
08:34:38 There we go.
08:34:40 So with respect to than the setbacks.
08:34:43 Obviously, we were able to along Grand Central create a much
08:34:49 larger public open space.
08:34:51 The retail space, Grand Central as it wraps around
08:34:57 represent, a previous proposal, the elevator that links the
08:35:03 public parking still maintained on this edge.
08:35:08 So the experience is much greater for coming to the project
08:35:12 and actually experience than the retail.
08:35:14 So this is kind of the main point of access for retail
08:35:18 users.
08:35:19 As they walk around, they are going to have one in the
08:35:24 sidewalk and one in the arch.
08:35:27 We also created a connection in the existing building to
08:35:30 allow them to take the shortest route to the place they are
08:35:33 going, right?
08:35:34 So we provided a connection between the existing building,
08:35:37 which is at the forefront kind of created our anchor point
08:35:40 for the project and people can walk through it and around
08:35:43 there.
08:35:43 We also have although not a retail component, it is a
08:35:49 commercial use so-so future tenants that come to the
08:35:56 project.
08:35:56 So I talk about the site plan as well as the open space as
08:36:01 well as on the east and west side in order to get open
08:36:05 spaces pinched our project in and create green space.
08:36:13 As well as the architecture in order to be able to address
08:36:15 some of the style in this community we basically redesigned
08:36:21 the entire building.
08:36:23 We have created a much more dynamic roof line for the
08:36:27 project.
08:36:28 We have incorporated some of the traditional elements that
08:36:31 you see in the community such as the brick, the arcade, kind
08:36:37 of curved arcade, the decorative railing, the banding, the
08:36:44 metal roofing.
08:36:45 So we provided a lot of alterations to the building that
08:36:48 creates a lot of movement, and we showed a very elegant
08:36:52 design for the community that you can see.
08:36:54 We are also tying in the existing building, whether it's the
08:36:56 metal roof, we are bringing that into our building as well.
08:36:59 You can see that urban sort of drop-off valet area that we
08:37:03 are incorporating into the project.
08:37:09 This is a much improved design and we hope you all feel the
08:37:12 same.

08:37:20 >>GINA GRIMES: The next issue to be addressed are the
08:37:24 trees.
08:37:24 And we have an expert tree consultant.
08:37:27 But before we get started, I just wanted to refer you back
08:37:31 to the previous proposal.
08:37:35 In the previous proposal we were requesting waivers to be
08:37:37 remove all three grand trees, one of which was hazardous,
08:37:41 and also to remove more than 50% of the on-site trees.
08:37:48 And in this proposal we are not requesting any waivers at
08:37:52 all.
08:37:55 The modified PD proposal is shown I think a little better on
08:38:01 this plan.
08:38:02 There are actually three grand trees on this site.
08:38:05 As I said, one of them was already declared hazardous.
08:38:09 And that was -- I have it.
08:38:16 I have it.
08:38:17 It's right here.
08:38:19 This than tree was declared hazardous previously.
08:38:23 And as well as this time.
08:38:26 The other two trees, tree number one and tree number two,
08:38:34 which are here and here, previously we had proposed to
08:38:44 retain tree number one on-site, and then when we were
08:38:47 proposing to retain tree number one on-site and move tree
08:38:51 number two off-site.
08:38:53 During the BRC, natural resources department expressed a
08:38:57 concern about the courtyard location of tree number one.
08:39:02 Tree number one was already in a state of decline.
08:39:05 And in that courtyard location, it pose add danger to the
08:39:10 residents.
08:39:11 As a result, Tampa natural resources department requested to
08:39:16 conduct further evaluation of tree number one, which he will
08:39:21 address in detail when he gets up to speak.
08:39:23 But in the end, Joe did conclude that tree number one now
08:39:28 was in fact hazardous and should be removed.
08:39:31 And Kathy Beck from the natural resources department has
08:39:34 agreed.
08:39:35 So now we are going to be relocating tree number 2001, which
08:39:39 was previously proposed to be moved off-site.
08:39:42 We are going to be relocating it in the approximate location
08:39:45 of tree number one in the courtyard in the building on the
08:39:50 south.
08:39:50 With that I will turn it over to Joel.

08:40:16 I have been sworn in.
08:40:17 It's a privilege and pleasure to be here once again in the
08:40:21 hall ohed halls of this chambers here.
08:40:27 I was commissioned and asked to make an independent analysis
08:40:31 of tree number one.
08:40:34 And I started that by looking at a visual inspection of the
08:40:45 tree according to the tree risk assessment criteria.
08:40:50 The tree risk protocol.
08:40:52 The first thing that I noted was the extreme compassion of
08:40:59 the root system over the years was it used to be some type
08:41:04 of parking lot, I'm assuming, and we had a number of roots
08:41:09 that were compacted, a number of insults and decay in the
08:41:13 roots that alarmed me enough to just initiate sending a
08:41:22 national Arbor certified climber up to into the canopy of
08:41:27 the tree, and he was looking for things that we couldn't see
08:41:30 from the ground.
08:41:31 And certainly there was a threat rah of things --
08:41:41 (Bell sounds)
08:41:41 That can't be me.
08:41:42 >>MIKE SUAREZ: You and everyone else, but continue, sir.

08:41:47 Here very quickly, some of the decay that was found
08:41:51 irreparable damage.
08:41:53 Decay leading down from the limb into the tree itself.
08:41:58 There's another incidence of decay and wound.
08:42:03 That prompted me to gone through the next level.
08:42:06 And I flew somebody in from Germany.
08:42:09 (Bell sounds)
08:42:10 And that person from Germany took an x-ray of the tree,
08:42:14 which is the most sophisticated piece of equipment that we
08:42:19 have in agriculture, and the than x-ray of the tree and also
08:42:23 did an EKG of the tree.
08:42:25 So? Sir, your time is concluded on this.
08:42:35 It's not you.
08:42:37 It's the whole combination of things.

08:44:18 This is a measurement.
08:44:22 It gives sonic feedback to a sensor that is put into the
08:44:28 tree here.
08:44:31 And as the needle, through is injected through the trunk of
08:44:38 the tree the impulses come back and are read out here.
08:44:42 So here is a needle that goes into the tree.
08:44:47 You have decay column.
08:44:48 And as you get toward the anterior of the tree, it's
08:44:53 completely decayed, which is consistent with the x-ray,
08:44:58 which the red here is advanced decay.
08:45:01 The yellow is about to become red.
08:45:04 >>LISA MONTELIONE: So it's decaying from the inside out
08:45:07 are?
08:45:07 >> That's exactly correct.
08:45:09 And the interesting thing is, Kathy Beck and I had
08:45:16 determined typically these inserts go here.
08:45:24 At about -- it's known as diameter.
08:45:27 But I had to put down at the basal section of the tree where
08:45:33 the tree would fail.
08:45:34 It's if it's going to fail, this is where a big tree fails,
08:45:37 and that's where all the decay and rot was.
08:45:40 That's when it became evidence that the decays was coming up
08:45:43 from the rat system.
08:45:45 So that's when the tree was declared hazardous.
08:45:48 And Mrs. Beck and I both concurred that it was a hazardous
08:45:53 situation.
08:45:54 >>LISA MONTELIONE: Fascinating.

08:46:15 Here is the asphalt that's been placed over the root system

08:46:24 And that is the old soil that's been there for at least a
08:46:29 couple of centuries, was blown away with a device.
08:46:42 Potting soil was put back into the root system and over the
08:46:44 root system.
08:46:45 The tree was repotted just like you do a tree in your house.
08:46:50 State-of-the-art irrigation with irrigation.

08:47:12 It is the most interesting tree evaluation, analysis, very
08:47:21 thorough.

08:47:34 I don't think any other elected official in the State of
08:47:37 Florida ever heard something like this.
08:47:38 And I looked at it and I said, well, it's clogged up.
08:47:42 The arteries are clogged.
08:47:44 I looked at it again and I said, no, needs a heart
08:47:48 transplant.
08:47:49 I looked at it again and thought I have to call a
08:47:52 neurological doctor because I think it had a stroke.

08:50:33 They listened at meetings following that public hearing.
08:50:36 The process just worked.
08:50:40 But today, what they present is very different in some very
08:50:44 meaningful ways.
08:50:45 It is now a project that not only fits the neighborhood but
08:50:47 will improve our neighborhood and the city creating vibrancy
08:50:52 and prosperity for those that are working there, those that
08:50:55 live there, and those that will come to visit there.
08:50:58 I am grateful for the process.
08:51:00 I am very grateful for the council and I am very grateful
08:51:04 for the Altman group for engaging in the process in the way
08:51:07 that they have.
08:51:07 And I am particularly grateful and offer my gratitude to Mr.
08:51:10 Altman for his clear commitment to this project and this
08:51:13 neighborhood and the city.

08:52:12 We think that it will bring upscale residential to the area,
08:52:15 which is needed north of the Crosstown expressway.
08:52:20 It will then benefit the University of Tampa, Tampa General,
08:52:24 even students probably at University of Tampa, as well as
08:52:27 others that want to be able to walk downtown, their office,
08:52:33 their homes, at Grand Central.
08:52:35 Also it brings some retail that's much needed in the area.
08:52:38 And it will help the area become more vibrant.
08:52:42 The landscaping is outstanding.
08:52:47 At snow park, it's all cracked up and broken up and a
08:52:51 hazard, you know.
08:52:52 So they are making a big difference in that way.
08:52:54 Also, it encourages walk in downtown, the churches at the
08:53:03 meeting in the area.
08:53:04 It will make a big difference for those residents as well as
08:53:07 visitors to the area.
08:53:09 The design fits so well.
08:53:13 I think it will be a property that the community will be
08:53:15 very proud of.
08:53:16 Again, I wholeheartedly support the office development.

08:54:16 I followed this project since it was presented to the
08:54:18 council last September.
08:54:20 And rejected.
08:54:22 And I have been through this rezoning hearing.
08:54:24 The time, money, community outreach efforts spent by the
08:54:27 principals to redesign the project for the betterment of the
08:54:30 Grand Central district is commendable, shouldn't go
08:54:33 unnoticed by the council.
08:54:36 Grand Central fills avoid in that Grand Central district,
08:54:38 that void being a mixed use community that enhances and
08:54:41 compliments historical architecture of the district,
08:54:45 promotes a more walkable and pedestrian, bike friendly area,
08:54:50 and actually brings much needed residential element to that
08:54:54 area which is a key factor for any area to thrive outside of
08:54:59 that nine to five workweek.
08:55:01 The development of projects in the downtown Tampa in the
08:55:05 Channel District actually represents that need for the
08:55:07 residential district, and the projects that coming up in
08:55:13 downtown and Channelside transform the City of Tampa into a
08:55:16 better place to live, work and play.
08:55:18 Your approval of the Grand Central will allow the Grand
08:55:21 Central district to contribute to the ever-improving
08:55:24 landscape of the Tampa urban core.

09:01:15 We have all kinds of establishments, but we have unanimous
09:01:18 place to sleep at night for living.

09:01:25 many years ago that one day the people will come back from
09:01:27 the suburbs and move back to this area in the urban core,
09:01:31 and it is happening today.

09:10:49 And the tree, I have never seen somebody bring somebody from

09:13:59 many calls for service everybody at this location.
09:14:03 And the response from Patrick Mesmer, detective sergeant
09:14:07 with TPD, said that in an e-mail, we have -- that we
09:14:13 received in my office, we have had 86 dispatched calls for
09:14:17 service at that location since March 12 of this year.
09:14:21 And over 150 self-initiated calls for service during the
09:14:26 same time period.
09:14:27 So I would like to have the Tampa Police Department appear
09:14:32 as well as our zoning staff to address what the issues are
09:14:37 at City Liquor, and why there are so many calls for service,
09:14:42 what is being done about it, and what process can we put in
09:14:46 place from a zoning perspective.
09:14:49 I know they are working on something but I would like an
09:14:51 update on what they are working on in order for us to
09:14:54 address these types of issues and these types of
09:14:57 establishments.
